    I think I really screwed up!

    We are 8 days late with our car payment. We are letting it go in the bk but it is our only car right now.

    They have been calling constantly-10 times or more. Neverending. So I finally answered and she said you are 8 days late this call is being recorded.

    She asked when we were going to pay for our car and I said I am not sure and then I said My husband lost his job(this is where i think I messed up-he did not lose his job just had a big paycut) It is what came into my mind at the time.She said well I am noting your account failure to comply and I hung up.


    Did I mess up? If I tell her that we are filing bk they will come repo it immediately, right?

    We have to have this car for atleast one more week. What do I do?

    8 days late is nothing. I think you have plenty of time before they come to repo it.

        You have to look at this from a contract perspective - that is what you signed when you obtained your vehicle. You are in breach of contract when you miss that first payment so they have the right to contact you to try to get that missed payment from you. You can tell them whatever you want to on the phone because it won't matter - all they want is the payment and they will tell you anything to get it. You are ripe for repossession anytime around the 30 day mark and on. Usually they do not come before that time. Repo places are busy but are hiring like mad to keep up with all the repos (there were three ads in our local paper today for that position). There is no need to be paranoid about all this - just get your personal possessions out of the car since you know they will eventually take it.

          I am just paranoid because I have no idea how my husband would get to work. We do not know anyone here and have no family here. Should I call them back and tell them we will be paying on so and so?

            If you need the car and you can make the payment then thats what you need to do IF you want ot keep it

                Ii highly doubt that they will take the car within two weeks after a missed payment. The odds are higher when you are 30 days or more late. If you are that worried about it, when they call again tell them you are putting a check in the mail to maybe hold them off for several days and don't answer the phone if they call.

                    Tell them you're trying to get a loan from relatives but you won't know for a few weeks. In a few weeks tell them you're hoping for a tax return but you won't know for a few weeks. In a few weeks give them some more hope. They don't want your car. BTW if there's no equity in the car there's a good chance they'd modify the loan and drop the payment.

                      I'm giving up my car also....I was advised by my attorney to stop making payments. My next payment is due on the 30th and I won't be paying it. They did send an offer for reafirmation but I have not signed it. I was told that right now I am under a 90 day stay from collections and that they can't take the car right now?????

                      Am I confused?

                        I don't understand why you think you can call them back & tell them you will be paying if you cannot make the payment--wouldn't that be lying as well.

                        You need to start thinking of a plan of how your DH will get to work once you no longer have a car. If that is the inevitable, then how are you planning to make it work so he can keep his job? Having something in place for what you know is going to happen, you just don't know when, should give you a little peace of mind.
