Look at it this way ... Amex is too cheap to do proper collections on their accounts so they farm it out to these bottom feeder collection agencies on contingency. It's very likely they aren't paying those guys enough to make it worth their while to do much except yell at you. A BK hearing isn't likely to get them any money. Plus it would require actually thinking and speaking in public, to a lawyer, probably not their strong suit.

NCO started calling us on behalf of Capital One when our accounts were less than 30 days late. They called both my mother and my husband's father. We caught the accounts up after that and then decided to file after that fiasco. They have not started calling again although our accounts are now all approaching 60 days late. I can't wait to deal with them again.

THese guys are definately the worst group of people we had to deal with. They looked in the phone book and called everyone with the same last name as me telling them they needed to get in touch with me. They even took the time to telephone neighbors and asked the neighbors to knock on my door for them. Do not ignore their calls or they will contact everyone looking for you. My suggestion is to take the calls to acknoledge that they do have the right number for you and tell them you simply can not pay at this time and drag it on until you can file or retain a lawyer to farm the calls.

so i called that stupid nco financial guy back and he wanted me to verify my name number address etc and i said well you have my info you have been calling me. anyway he said he has all bk info and all correspondence will go through my attorney now. so only time will tell if that is so. oh and it was a capital one account.Filed Jan 23rd, 2009
