    newbie - chapter 7 questions - please help

    Hi,

    My situation:
    Location: South Florida
    Debt: 60K credit cards
    Student loans: Yes

    I have these questions:

    1. Citibank will not give me the exact credit card numbers for my account. I have only 12 and they are willing to give me 2 last numbers, so how do I get my full account number or can they discharge my balance from my social security number?

    2. I have a co-signer for my student loans. I know I cannot discharge the student loans, but I hear that I have to put them on schedule F even though I dont want them discharged...is that true?

    3. Some creditors I owe money to are not on the credit report. for example: LaSalle Bank from chicago - I owe them $50. Do I put it there also?

    Hi,

    1. Is Citibank on your credit report? If not you can try to file all Citibank account and list them as credit card debt and approximate amount. Don't quote me but I do believe it is the creditor that is the most important. You could probably just list that you do have 12 accounts with them and list the total amounts.

    2. Student Loan: I was told by a lawyer that government and federal student loans are not dischargeable. But if you walked into a bank and got a "student" loan, that should be dischargeable. Your Co-Signer will be affected and obligated to pay though.

    3. If you know the creditors name, phone, and or address, they can be included in your BK. I did not have a lot of debt on my credit report, so I just gave them the bills I had received in the mail.

      Well, the questions I have had was:

      Someone told me that even if I dont want my student loans discharged, I am obligated to list them on the schedules.

      Is that false or correct?

      Do I have to list all debt I owe even though I dont want it discharged?

        Yes - all debts must be listed - even non-dischargable ones.

        If you even think that you owe someone something, you should list them. Account numbers and amounts are not as important as having a name & a good address for a creditor. BK is mostly about notification.
