2004 examination

341 meeting was on Nov 08. I had 6 properties. Tustee asked, how/why did I get the homes? How did I find them? Did I live in them or rented them out? Did I put any money down or not? Who did the mortage? Who did the closings? This guy was swinging for the fences and caught me off guard, the attorney sold me on thought the everything would go smoothly. He continued our 341 meeting for Dec 08. The attorney told me finish you cc counseling and don't worry about the trustee he wants more info on the brokers and closing agents of your loans. I had mixed emotions,anxiety,stress,fear,pride you name I felt. I did the mistake of not showing up at continued 341 meeting, I have a problem facing situations and tend to turn away, I know I messed up. Now the trustee filed for an extension to object my discharge or dismiss my case. He also filed for a 2004 examination request documents as far back as '05. I told the attorney I HAD an LLC do you need the the bank statements? NO. Now the Trustee wants to see them and all others I might have. My attorney said if I don't show up 2 things might happend,either I got subpoena to show up with documents or my case will be dismissed? I don't know what to belive from this guy any more, I don't think all attorneys are bad/greedy, but BK attorneys really care more about volume more than just researching their clients documents and background.Helping clients decide what are their options thoroughly even if that means not filing at all. I am trying to fihght this anxiety/fear and go to my examination without my useless attorney. It can't be worse then going with him. I've been reading through this forum the last couple of days wish I would've found out sooner. I wish all you guys the best in 09 and thans for the support GOD Bless.

Well, many attorneys are volumn attorneys. That is the big problem where someone with a complicated case decides to go with a "cheap" attorney, you get what you pay for instead of going with the more expensive attorney that would actually help you. (ok, off my soap box )

From what you describe, it doesn't sound like the trustee is going after you per se, he may be exploring the possibility of mortgage fraud and going after the brokers and agents involved in your real estate transactions.

All you have to do is provide the documents, is that really so bad? In the big picture, it isn't.

Don't give up. If you bury your head in the sand now, you will royally screw up your financial life, and over what...not provided a few pieces of paper to the trustee...Don't be that person.

You sound like a very intelligent and capable person based on your description of your situation and your ability to try to invest by buying homes. You need to sit down and make a plan. List out what you need to do to fully comply with the Trustees requests. List in order of importance. Then start concentrating on completing your list. Don't look at the other steps until you have completed your first step of the process. You don't want to get over whelmed. the Trustee did not automatically dismiss your case, correct? I would take that as a good sign. Get to work and keep your head up. God be with you through your journey.

Thanks for the info and encouragement. No my case has not been dismissed Truste has filed for examination. I will get my documents together and give them what they want. Like HHM said its not a big deal in the big picture.

Hey goodluck!!! I know whats its like to be dealing with the trustees. My problem is not the trustee BUT the UST. You can go back and read my journey, its not a good one. Anyway, just want to say I feel your pain and hope that everything turns out great for you.....
