Hi, my husband and I went to the lawyer on the 3rd and still don't have a case number yet. I know it takes time as I am self employed and there is alot of paperwork that we presented. Has anyone dealt with National City for an unsecured account? They are ruthless in the messages and conversations so I was wondering if anyone had creditors show up at 341 and what happens when they do what do you have to say to them. Also surrendering my car, I will deliver it to dealership but I really don't want to talk to anyone there, any advice? Do we take our plates off when we deliver it? I just had to buy new tags December 20th and would hate to have to eat $96.00. I have been reading everyday on here and it has helped pull my husband and I together to get through this and also gave us the courage to file for bk so thank you all for doing this. We live in Michigan.

Until your attorney actually files the petition would you have a case number.
When National City Calls, tell them, stop calling you, call your attorney instead.
The dealership doesn't necessarily own the car unless they actually extended you the credit, make sure you get that in line, call the original creditor and let them know what you are doing.
Call the DMV and ask them about receiving a refund for the tags you paid on, and most likely they would tell you to take the plate off the vehicle.
You shouldnt need to have courage to file a Ch. 7, you are starting over from scratch, and everything is going to be 100% better after your discharge.
I filed a 7 in 2004, and two years later, I bought a new car, had new credit cards(regrettably), and a year later I bought a brand new house.
You will be less of a credit risk after your bk.
Dont believe all the hype.

The link below I created a BK script you can use to field those collections calls. Don't fight with them or argue. It just puts stress on you.
As far as the car. I would ask the attorney what to do with the car. If your not driving the car take the plate off and you can transfer the plate to another vehicle if you buy a beater or able to get another car. Keep insurance on the car until it's discharged or you turn it in.

Thanks for info. We are filing for 7 lawyer thinks we will squeak through. Keeping one truck still paying on, one car paid for, house, and lawyer said I will be able to keep my business also. I contacted his office regarding Nat City calls, he said to tell them filing bk and for them to call him, they said they will only talk to us not our lawyer and we must call them by today at 4:30. They left it on my voicemail and I have not called them back, my lawyer told me to not talk to them other then what he instructed and I have not. So nerve racking, I don't have a case number yet and will feel better once he gets that done, should be any day. I did ask him about surrendering the car and he told me to drop it off at the dealership I leased with. I have a call into him regarding the plates and tags but he is in court today and I am thinking about delivering on sunday when dealership is closed, leave note and put keys in envelope and drop in drop box. I just don't know if this is the right way to handle it or not, and yes I will keep the insurance on it until I know for sure they have it. Also we have a little over $100,000 unsecured debt.

Good Sounds like your attorney is on it. I had Chase try to play the game with about they wont talk to anyone else. I used the script and and said.. Fine, this is the last time I am offering my attorney information after this call I will not be taking your calls anymore.. They took it..
I even told creditors I was recording when I wasn't.. Calls pretty much stopped immediately after I provided attorney information.

I know you don't want to face the auto dealer, but I think the way you are doing it will just add to your shame- not help you. Think of how you will feel dropping it off under cover etc. Doesn't seem right. Just go in there, find someone, give it over. They don't care! They don't know u!

I as so many others I am sure have dealt with the conversations, not nice I might add, over and over again. The thing is, is that with the dealership I have to go to to return the car is a city I worked in for over ten years and yes they do know me. I have since moved to a new city, with a new business, but nonetheless, some of the salesmen women and managers there have been my customers, so I guess if I called and told them something like I am returning the car because I am in the process of claiming bankruptcy due to medical bills without insurance type of thing it wouldn't be so bad. I feel like I would have to give some kind of explanation if I actually have to see and talk to people, and although I hate to lie, I certainly don't want to admit my debt is from unsecured cc and signature loans and have a whole buzz line going on. Thus a dilemma I will have to figure out and quick, I would rather deliver the car than have them come and pick it up.
