I'm in FL and looking to move back home with my family where it will be rent free for now in NJ. I anticipate moving in March. I'm unemployed and can't find a job here in FL. I will be unemployed in NJ too and hope to find a job. However, I won't have any rent or utilities at home. After my BK is discharged I'm looking at joinging the Marines. How will this effect my BK filing? Will I have to wait 3 months to file when I get to NJ? I'm just worried I might be sued by then. However, I have no assets.

If you're unemployed I don't think it will affect it much at all. To qualify for the means test they will look at the last 6 months worth of income before filing. So, depending on how long you've been without work, moving in with family shouldn't cause any problems with regards to you income/expenses. On the other hand moving from one state to another can have an affect on where you need to file and what exemptions you may use.
