    Continuance?

    So my 341 is Monday.

    On Friday the TT asked for some stuff.

    I got 95% of it to my attorney. Maybe the rest Monday AM.

    My attorney told me this morning not to go crazy that they may continue it since they asked so late.

    Question, why go and have the 341 then? Why not just grant me more time initially.

    Is this a game they play, anyone with experience here?

    hey, our 341 is on the same day ...neat
    i too received a continuance on my last meeting and am still clueless as to the reasons why. the lawyer blames the trustee, the trustee says the lawyer didn't submit something on time. back and forth.

    hopefully it gets cleared up tomorrow and i can finally move on with my life. i won't say it is a game they play, but putting things off is essentially gambling with someone's future.

        No. it may be because they can in fact handle all the issues during the 341. It may be something simple and doesn't need weeks to ponder over.

        So, why would you want it delayed then? Plus, creditors already have the date, and it may be too late to stop them from showing up too.

        You just never know.

          Nah, it's better to have the 341 to deal with the stuff that CAN be dealt with then and there. At my 341, the trustee asked for some more stuff and "continued" the 341 hearing until about a month away. The day after I got the stuff to her, she wrote her report and indicated that the 341 mtg had been held, no assets, and that the continuance was not necessary. The same may be true for you, esp. if you've already been able to get 95% of your stuff to your atty. Good luck!

            Our341 is Monday also, 9 a.m., nervous about the reaff, we don't want to so wondering what to expect on that.

              I am taking three huge binders with me to keep in the car.

              If the trustee needs to see my kitchen sink and swivel chair and pet parrot in addition to two years of CC statments they will be in my car.

                I think you'll be fine if your bringing everything you can with you. I'm jealous that your 341 was in four weeks. Ours is next week so we waited six. But almost over. Let us know how it goes and good luck!

                  Folks, it depends on how busy your district is. With the economy the way it is, and all the layoffs that are happening now, the BK situation is only going to get worse.

                  Lajazz, your situation is similar to what ‘Hub and I had. A week before our scheduled 341, we had a telephone conference-dress rehearsal if you will-with the trustee’s assistant. In this telephone conference, we were asked most of the same questions that we would be asked at the ‘real’ 341. So in that, we were thankful for the rehearsal.

                  However, we were asked for additional documentation as well—namely our Marriage License. ‘Hub and I use different surnames although we are married.

                  The trustee did not want a copy of the license, although we pushed a copy of it toward him. It turned out that several months later when we had NOT been discharged, the lack of that copy was the hold-up.

                    The meeting starts the clock ticking, it does not matter if you have a second 341 the clock starts from the first 341.

                      so how did it go?


                      mine was over and done with in 10 minutes. i got questioned about my large student refund deposit after filing, but she didn't give me grief over it. no one showed up for me thankfully. seemed like everyone else ahead of me had at least 2 creditors from banks looking for them. also, 2 people didn't show up because they had too much fun over the weekend and got arrested.

                      oh man i'm glad this is done.
