    Filed 12/23, no notice from court yet

    Our lawyer sent us an email saying our case had been filed 12/23/2008, gave us a case number and said we should receive a letter from the court in about 10 days telling us the date of our 341.

    It is now 1/11/2009 and still no letter from the court. Is this something to be worried about? If my lawyer gave me a case number, then he defintely filed the case correct?

    Also, I have been reading on here that you are required to give notice to your creditors that you have filed. When am I supposed to do that? At this point, I have not been told by the court or my lawyer to do so.

    Just getting nervous, really really want to know my court date....

    Give it a few more days. Lots of holidays in that period and such.
    If you have nothing by then contact your attorney and find out why.

      It's the holidays and vacation time so things are backed up with most employees just returning to work last week - bet you will get it this week. He electronically filed your case (as most are) for you to immediately have your case number.

        NO i wouldn't worry. you may not have a trustee assigned yet. It took almost 2 weeks before i got my first trustee.

          AS the two previous members posted - don't sweat it. Holidays, mail also slow.
          Your creditors will be notified by the court. You yourself do not have to contact any of them.

            Will it delay our court date?

            So is this really going to push back our court date from the usual 30 days? We're kind of on a dead line, we have jobs lined up that will require us to leave the state on Feb 16th, was hoping that we would have the 341 done before then by filing on 12/23.....

              Contact your attorney Monday morning - that will alleviate your worry.

                Pacer

                You can also sign up and check in the PACER system. There is a sticky on the forum here that explains most info. In Florida everything is electronically filed. When we filed, I created a pacer account (You need a debit or credit card for immediate access) the same night we filed. I was able to get the case number (which you already have) as well as see anything that has occurred since the filing. Such as assignment of a trustee, judge, 341 date, etc. For example when they send notice to cerditors, it shows.

                But also be careful as it does cost you $.08 per page to view files.

                  I found a phone number for the bk court here and called prior to receiving my notice in the mail. It was an automated system and after I put in my SS# it told me my case # and when & where my hearing would be.

                    Finally got our 341 date

                    Okay, we got our letter telling us we are scheduled for 1/28/2009 at 10:30 AM.....

                    The letter only says to bring photo id and social security cards.

                    I have read somewhere on this forum that other people have been told they will need to bring bank account records, car titles, etc...

                    When and how would we be notified if we need to furnish anything like that, or is that something they request after the 341 meeting?

                      Your attorney should advise you on what you will need to bring. It is possible that your attorney already has the necessary info. Check with them.

                        Uhhhh.. I was filed 12-22-08, I had my notice by 12-31. Im in metro Detroit, and trust me - because of the big 3 and the local economy tied to it - the bk court is innundated with bk's.
                        Retained bk7 laywer 8-12-08, Filed 12-22, 341 Meeting Scheduled 1-29-09
                        Discharged 4-17-09!!!
                        Reason for filing: Medical, NOT irresponsibility with credit.

                          It happens all the time around here, you file and wait a week or so to get a trustee assigned. Then the client doesn't receive it in the mail for another week. With the holidays and everything, it is quite probable that is the reason. The trustees are manually assigned here for every case that is filed.
