I could write a screenplay based on the last 24 hours of my life.. but not here.

My latest dilemma, besides still not having my car back from impound...

I received notice on Monday that my case was dismissed on based on missing summaries. I filed the summaries yesterday and the motion to vacate the dismissal today.

My 341 is scheduled for tomorrow at 2pm. If the case was dismissed and I have not heard back on the motion to vacate do I still show up tomorrow? I've missed two days of work from not having my car and need to save whatever sick pay I might have for the actual 341 meeting. I could get a 1 hour break from work starting at 1:30. Car is still in impound and I can't get it out until payday (friday) and I would have to take a cab to get from work to the courthouse which I also can't afford and would have to borrow money from my boss most likely. The clerk was surprised that it was dismissed before the 341.

Anyone? Bueller?

Since you filed pro se you can call the trustee and ask him.

Call the Trustee's office FIRST THING IN THE MORNING! You need to see if they canceled the meeting.

Did you check PACER yet to see if the order to vacate the dimissal was docketed yet?

Check your case summary and see what it says, then post back.

If you motion isn't docketed, ask to speak to the Case Manager Supervisor. Usually, they'll assign someone else when your case manager is out.

I was lucky... my Case Manager Supervisor seems to docket my papers (filings) when my case manager is out.

In any event, I was told that they are still date stamped on receipt, and may sit in an inbox for a few days. So long as they are stamped, they are okay. You can even talk to the intake desk to see if it has been stamped and scanned, but not yet docketed (just for piece of mind).

I did have one instance where I submitted papers in a different division (of the same District) and they messed everything up... never scanned the paper... so it never got docketed for 2 weeks. However, a simple call got it docketed, but the file date was the original stamp date (that I hand delivered it to the intake desk at the other division).

Anytime you're unsure of any emergency type motion, just call and ask. If the person is out, talk to the supervisor.
