Omg!!!!!!!!!! I am totally sickened by this!!!!!!!!!!!

Ok, so i go on pacer today and then i call to find out exactly when I will see the discharge coming thru. She tells me that it should discharge friday but then it will not close until the trustee sends a final discharge statement. So she tells me to call the trustee. So i inturn send an email to the paralegal and ask her to call. She send me back an email saying. That the US trustee is auditing us and that they granted them a 30 day extension. I email her back and ask her when and who granted the extension. I knew we were being audited by the US trustee for presumption of abuse but that was back in late sept early oct. I supplied all the information that they requested and that was the last I heard from them. We went to our 341 and it went great. Now, this. I am soooooo frigin pissed and disgusted I could just vomit..... WTF........ Why didn't pacer have that information. There is nothing about the us trustee on pacer. What i am going to do....... I just want to scream. Today was the last day for objections. I am sooooo sick over this.............

Oh, you poor thing! Shouldn't there have been some sort of document filed by the U.S. trustee or an extension of a deadline - SOMETHING that should have showed up on your pacer report!

Here is my view.

First, your discharge is what you want. Closing does generally take time and yes, some folks get an autoclose on or about the same day as the discharge.

Second, if you were already audited, it just means that the Trustee is double checking their records. They are required to give an accounting anyhow in order for a case to close.

Was this an asset case?

Ok let me get this straight, firstly the extension for an extra 30 days...is that for your discharge or closing? is your discharge still going ahead this week??
also when a 30 day extension is requested why would this not be on pacer and who was going to notify you?
if it is just for the closing then you should be all set, it sounds like he will just check over everything you sent him to close it.......

What would cause an audit by a US Trustee?

I am over the median income in Califirni and I think I am a no asset case as my house is under water and I think that my attorney used my exemptions to keep my cars, clothes and my furniture.

I am not sure how to figure this out but he was confortable with it.

Hi, No i am not an asset case. The UST requested additional information as assumption of abuse. I have them all the information 4 months ago. I never heard anything else after that.

No i do not think that I will get a dischage until the audit is done with. The UST trsutee requested information on a presummption of abuse. He wanted 2 years worth of all cc statements, water bills, sewage bills, gas receipts etc. Its was crazy wat he was asking for, but we gave him what he wanted. That was in Late sept. early Oct. then we never heard anything. NOW today the paralegal says that he requested an extension today. THE LAST FRIGIN DAY FOR OBJECTIONS...... I am literally sick......

The UST trustee never said why just the persumption of abuse and requested a ridiculous amount of information. like CC statements from dating back 2 years. OK. I would of needed a storage unit for that. It sucks they wait until the last day and then go after you. Its like giving a kid candy and then taking it away. I am really upset.........

I thought anything that goes on gets listed on pacer, but i guess not. The UST waited untilt he last minute to ask for the extension.

that 10 day rule of them after the 341 to file for abuse does not exist either... and the fact that they wait until the last day sickens me. I have heard that a lot on here, almost like they think it is all a game.... very scary that they play with ppl like that. I am sickend with everything going on in this world.... everything is so corrupt.

I too don't like last minute changes in their position. This could have been dealt with a long time ago (30 even 60 days ago!).

I know exactly what you're going through. The UST probably requested the extension at the last minute and the paperwork is sitting on someone's desk to be entered. The worst is contacting your lawyer and getting a "no big deal" response while your life is hanging in the balance. Your lawyer failed to follow up with the UST to make sure the documentation was acceptable. Your lawyer now needs to earn their keep and communicate with the UST attorney.
