    Am I getting in over my head trying to do this on my own???

    I have a truck and dirt bike as collateral for a loan. Is this going to be difficult to file pro se? I am willing to give them up in the filing... it would actually be a good thing. Other than the bike and truck, I am a chap 7 with no other assets. I just don't have money for an attorney so filing on my own is my only option.

    If this ia what we call a No Asset case, then by all means, filing Chapter 7 pro se should be a walk in the park.

    First thing you need to do, is get the NoLo guide to filing Chapter 7.
    Chapter 7 (No Asset/Non-Consumer) Filed (Pro Se) 7/08 (converted from Chapter 13 - 2/10)

      I have the book... but i was just wondering if there will be difficulties due to the fact that there are liens on the truck and bike... is this something that will be difficult to deal with on my own? I think since I am willing to give them up, it shouldn't be so difficult but I wasn't sure.

        If you're surrendering them... there is nothing that you need to do or worry about.

        Eventually, they will get a motion for relief from stay, and then seek to repossess the items. They'll probably try to get you to reaffirm them. Just say no.

          i think it depends also how many months you are behind.
          besides you cant reaffirm it if ever u wud want to keep it.
          coz they would base ur income on how u are capable to keep it.
          so i would say it wud be ok.
          I am about to do chap 7 pro se but not for me for my friend. which i have never done it except if im at work. but pro se seems to have a lot of drama coz you really gotta be careful with everything

            Sorry... but what does "reaffirm" them mean?? I would love to drive the truck to the bank and hand them the keys and be done with it... it probably isn't that easy huh??

              Reaffirm means that you basically re-sign the contract documents and the debt is not discharged in the Bankruptcy.

              Don't worry about that. Just say no to them.
