    Day 61 question and pacer

    Hello Everyone.Just checked pacer.There was a tread awhile back that said what to look for on Pacer.Can someone direct me to it.When I checked status it says Awaiting discharge, day 61.I am in the central calif district which I know takes a long time for the discharge to get done.The last entry on my case was 341 HEARING .Does this mean that there are no objections.Being at 61 days and maybe no objections does this mean that creditors can no longer object?Also my lawyer put down circuit city and dell as secured which pissed me off but neither have asked for anything.Is a secured debt also discharged if they have not responded with the 60 days?.Thanks

    That's interesting. Mine says "awaiting discharge" and I have not even had my 341 or completed my post bankruptcy course. I looked at it for the first time today.

      In most Districts, it will read "Awaiting Discharge" from day one. They add all the flags necessary to complete your case up front if possible, such as "DebtEdDue" and things like that.

      Hang in there opus007. There were some holidays recently... and they are probably backed up on top of it.

      They could be waiting on the Trustee's report. Or, it could be something you forgot to provide.

        I just talked to my lawyer and asked about circuit city and dell being listed as a secured debt.She said it was my obligation to contact them and get a reaffirmation.I told her why do I have to do that.She said it is my responsibility.They never told me I had to do this.I told them then... what the hell am I paying you for and they hung up on me.I am so pissed off.
        Do I have to by law contact them?????What if I do not.I thought this was discharged under the BK.Help.

          Since they filed as secured, their liens survive your Bankruptcy Discharge.

          That means, with no re-affirmation, they may come for your property.

          The likelihood of them coming for it is low.

          Your lawyer is lazy. The lawyer should have guided you through the whole "purchase-money security interest" (PMSI) that places like Lowes, Home Depot and Best Buy have on products you purcahsed from them.

          The lawyer should have talked to you about re-affirmation, redemption or surrender as well.

          The lawyer should have talked to you about a "ride-through" or hoping that nothing happens if you don't select one of the three options.

            So should I contact dell and CC and ask for a reaffirmation?Lawyer swears they walked me through this.I remember exactly what she said and she did not walk me through it.I told her why did you list CC and Dell as secured as I wanted them unsecured and she said do not worry we will just wait and see how they respond.Now I am left holding the bag.

              I am not worried about them coming for anything as I know they wont.I just need to know if I should contact them and by law if not what happens.Oh called my lawyer back and fired her. and will be reporting her to the bar for misrepresentation.
