    quick question about renting after chap 7

    iknow ive read this in another thread but i want to make sure i understand.

    when filing a chap 7 and surrendering my home, why does it matter how much my rent is on new property? is it for the means test? or trustee?

    for instance i havent filed yet but i did sign a lease on a new rental where the payment is 600 less then my p& i now. will this affect my filing at all?

    i told my lawyer i signed new lease but he never asked me how much? he just put in filing papers that im surrendering my home?

    sorry for asking again but want to be sure

    actually will trustee even ask about my plans for rent if its put in their i am surrendering the house?

      Frest, don't know your time frame or what has gone before but you could have gotten several months at the least of free living - no house payments and no rent - maybe 6 months or so.

      As you have signed a rental lease, you might consider this - maybe lose the deposit if the numbers fit. - jb

        your right , I just found great place. Will trustee ask about new place or will not even come up?

          It definitely matters for your schedules - if you have disposable income after you've paid your bills.

          Not sure because I didn't file a home but I think people put they intend to reaffirm and then don't. This way they can use the mortgage numbers on their schedules. But if you don't have disposable income, even with your new rent amount - this would be a moot point.
