    I plan to file my BK next month and need a different car!

    I am planning to file for Ch 7 at the end of January and I really don't think I am going to get through this winter with my current vehicle. I decided last year that I would not drive this car for another winter but because my DH and I divorced I still have it. And, now I have nobody else to rely on for transportation when we have really bad weather. My current car is so bad on slippery roads that I would consider it dangerous. We've had severe winter weather this week and I forgot how bad it was until Friday. It's a newer compact car and I owe around $4,200 on it. I suspect I could get around $9,000 for it (private party sale).

    What are my options here? I want a used AWD or 4x4 for $10,000 or under (which seems reasonable based on my research thus far) and I'd love to finance the difference if I could find someone to finance me (stopped paying CCs five months ago) and reaffirm the loan. Would this hurt my filing? I really have to do something but I don't know what I am allowed to do at this point.

    Any suggestions?

    If its newer and FWD what you need is Snow tires. No need to buy a whole new vehicle.
    BTW anything I say here is just me yapping based on my experience. Your milage may vary.

      Just curious but you said you stopped paying 5 months ago on cc's. Have they come after you in anyway? I am wondering how long before they file suit? It has been 3 months for us since we stopped paying and we are also filing at the end of Jan.

        Do NOT buy a new car on the eve of filing. It will be flagged by the trustee and it will hurt your filing. If you need to buy a new car do so, but wait about 7 months before filing. If you can't wait 7 months, at least wait it out 4-5 months.

          I bought my new car 5 months prior to filing. The issue was never brought up.

            AmEx sued four months after the last payment was made. I will not be surprised at all if more follow suit before I file in January.

              I guess I'll be waiting then because I am definitely filing in exactly one month. I had a feeling that buying a car at this point would be a really bad idea. I'll stick it out this winter and get a different vehicle after discharge. Thanks for your help!

                If you can get the credit to buy another car then it should not affect you BK just keep pay through the BK and you don't need ot reaff the loan.
