    Thank you TEW. So i just need to include his monthly income/expenses just to get a case number and then can get copies of his pay stubs for the past 6 months if the trustee requests them? His income has varied GREATLY over the past 6 months due to job changes and then a transfer to FAA academy where the pay is zilch. Even when he was making more money at his other job, he never made anything close to the 51K which is the 2 person amount for means test for Ch. 7. So does this seem to be in my favor and make it easier???

        you need the exact amount to file and the trustee will ask for them if you are filing pro se

          So do I average his income over the past 6 months or just include what he is making now at the academy? His pay is only 9.50 an hour but he made about 25.00 an hour a few months ago and his income will change in March before I am discharged. He also is receiving per diem per month in addition to his 9.50 but that ends in feb. Aaaahhh!!!!

              I would like to discuss this with him, but unfortunately, it's a long story I can't get into on the internet. I thought I could just file without telling him. I would be yelled at for racking up so much debt in the first place, I know it's my fault and I do take responsibility, but it was over 6 years ago, I've made mistakes. he knows about the debt, but probably thinks I took care of it somehow. I don't even want to do this, but I have already been sued and have a judgment. Any suggestions? I really at this point am so confused and don't know what to do.

                  His monthly income right now is approx 3770.00 but that includes a per diem monthly amount of 2450.00 which ends in february when he graduates. So if I put down a monthly income of 3770.00, will that make me ineligible to file Ch. 7 since 3770.00 x 12 is more than 51k? He is only making the 3770.00 for 4 months but then his salary drops to 40k a year in March when he is no longer receiving per diem. Should I wait to file then or does this not matter? TIA.

                      I know, and I thank everyone for answering my questions so far. Some people that I have spoken to told me to not file, just leave it alone, I don't make much and the creditors can't get much out of me, or that it isn't that much debt to file over. Do you have any suggestion or an opinion? I am really so confused and don't want to make any mistakes, thank you.

                        OK last question.....if I wait till March when he graduates and his income has dropped, if I am working (hopefully I am by then) and can pay towards expenses, is that considered preferential payment since I am paying him and not my creditors? Also, what if my income brings us over the 51k mark which is the cut off for FL ch 7 eligibility? Sorry for all my questions. I am just soo confused! Thanks a MILLION!

                          dr618..I know your thinking this is so BIG and he will not understand. But i think if you just set down and explained to him and how it just got bigger as time went on he will understand.

                          I told my GF and she had know ideal i had so much debt on credit cards she thought i was joking at first.

                          So i think its just stressing you at this point so much you could tell him over the phone and than be time you see him later he will probally think it over and understand.

                            He knows about all the debt, thought it was crazy then, does not even know I was sued. I know from reading that people here have way more debt than me. Thank you for that, Journey.

                                Thanks TEW for all your help. So if I get a job say in January and can pay towards food/rent, the trustee wont try to get it back from my roommate for paying him instead of my creditors?
