        If you do not do direct deposit and your bank statement does not reflect your entire income, should you be honest and tell them that your spouse made an additional $1000 a month for the past 6 months.

          Um, yes!!! Especially if it's being reported to the IRS. They use your tax returns to validate.

            I live in TX too, and mine and my husband's income was above the median. We were able to file chapter 7. IIRC, I have seen people on here who were well above the median and were able to file 7. As already mentioned, whether you go 7 or 13 depends on what your disposable income is. Even though we were above the median, after our expenses were added up, we had -$46/month.

                It's based on a formula used to calculate what you can contribute to unsecured creditors in a Chapter 13 Plan.

                It's officially called "disposable monthly income".

                  Mintz - PLEASE be honest and do not try to hide anything. Believe they will find out and that will be major for you. By you hiding the extra 1000.00 will only come back to bite you in the azzz.
