    341 in 11 hours and counting.....HELP!!!!

    I have literally been hovering in this forum ALL DAY! I am so nervous, even though I know I shouldn't be. Is it normal to run every worst case scenario in your head over and over? things like will he questions the values, does he think my unemployment is MORE than enough (I do know how stupid that one is... we can barely afford food while NOT paying our bills, I couldn't even imagine if we were paying stuff right now), will he question how we get by (we don't, that's kinda why we are in this situation right?)

    I have a good job I start next week after 9 months of being out of work (I sell to construction companies), will that affect the outcome? Will he expect me to be able to pay stuff back? Should I mention it, even thought it's not a done deal until I actually start (which will be after the 341)?

    We had to move out of our rental house into the in-laws because we could not pay our rent and our landlord sold the house to avoid a bad situation herself, will that question come up?

    I am trying to remain calm, so as not to concern my wife any more than she already is, but should I worry?

    I am pro se, so please don't say ask my lawyer, I honestly couldn't afford one without starving my family or pro-longing the situation. We are a no asset case with TONS of debt because I used to make very good money and THOUGHT it would last forever! I know better now!

    and it makes me sick to my stomach, even after that i think i will imagine every worst case scenario for the 60 days.. I cannot wait for this stress to be over..... I always think no matter how easy everyones else was mine will be a nightmare .... Maybe that is common..... But honestly with reading your post..... it seems as though everything will be just fine with you... just fine.. try to relax and it will all be over very soon.

      If you owned anything 2 years before the BK the trustee will fight you tooth and nail. Trust me I know

        ourf8 you will be fine. You are excited and scared at the same time and that is normal. I question anyone in this forum saying the 341 was a piece of cake. Well, walking out we all thought that (some of us) but in my case, the 341 was sitting there for 10 min saying yes - no. Thats it!

        The less you tell them the better. The more reasons you give the more questions they will ask.

        Peppylady is correct but not entirely. I had BOA, Citi and a $275000 rental house mortgage that was less than 18 months and nobody batted an eye. Now opening credit 6 months before filing is another thing but I was fine with this those new accounts. Every Trustee is different. My trustee actually went after my wife's income because she didn't file with me. But with me being honest and upfront with ALL OUR debt, they had nothing.

        If you have been honest, upfront and correct with everything - you will be ok.

          I just had my 341 last month (2 of them, the first one and a continuation). The meetings were fine. Just remember to answer the question asked - only the question asked - and do not volunteer any information. Answer as briefly as possible: Yes or No as appropriate. I even had the US Trustee at mine too, via phone.

          I was nervous too. But at the end of the second meeting, the panel trustee declared a no asset 7 with no distribution and filed the paperwork accordingly.

          Even if you had assets two yrs ago, the trustees are not going to jump down your throat. They are looking for assets you have now. If you had assets you sold, they want to know where the money went - for most of us it was to living expenses and not into a luxuries. Just know that if you tell the truth and it conforms with your petition, you will be ok.
