Question about being discharged

    Question about being discharged

    To make this short pacer just showed today that the trustee is releasing herself from the case with no assetts.

    Well my 341 was back in 8/25 and it went well. Well the meeting was reset a couple of times due to some paperwork errors but I never had to reattend the meetings. Pacer showed the the time for creditors to object was 10/28 amd exemptions was 9/28. Obviously that time has come and pass.

    But since I just received the notice of the trustee releasing herself today does that mean I have to now wait 60 days? Or since the time for objections has come and gone will I be discharged anyday now?

    Your times seem all messed up. If it's a no-asset case, it should auto-discharge 60 days after your (last) 341 meeting.

    I can't tell from your posting when your final 341 was.

    Or, you may have a FLAG in PACER which is keeping it from auto-discharging. Look at your Case Summary under "Flags" and let us know what's there.

      On mine, Case Summary under flags says MEANSNO, what does that mean,

        MEANSNO means you passed the Means Test. (It really indicates that you don't have the means to fund a Chapter 13... therefore you qualify for a Chapter 7.)

          Well my 341 was on 8/25 it was reset due to paperwork error to 9/22 and I did not have to attend. Well due to another stupid small error it was reset again to 10/27 and then again to 12/1 which I did not have to attend. The trustee was being easy on me since I was pro-se and letting me correct errors. Well now that all the errors are corrected she released herself from the case.

          After the first 341 meeting that I attended the objections were set to expire on 10/28 and that time has passed.

          My question is since the objections have passed and I finally got all of my paperwork corrected and the trustee just released herself from my case today will I now have to wait 60 days or will I be discharged now any day?

            I think it's 60-days from the first scheduled 341... so... it should have expired, as far as creditor objections.

            However, the Trustee had issues and rescheduled the 341 a couple of times. This probably messed with the case closing because there was no Trustee Report.

            Maybe it will auto-discharge tonight.

                Yes, the Order of Discharge arrives by mail.

                To the OP.......I think what you may be referring to is the Trustee resigning as your Trustee. Are you able to post any text of the document? This may help us interpret what this document is all about. Just remember to leave out any personal info.............leave just the legalesse mumbo-jumbo.
