    Is This An Error Or Am I Missing Something?

    It's been 93 days since my 341 and still no discharge...I am beginning to feel like PaKettle but am not panicking since we did file in the same district. Anyway, I just checked Pacer and found a new filing from 11/28.

    Recovery Management CA on behalf of GE Money Bank (paypal buyer credit) has requested a courtesy notice of the filing, stating that they are a creditor.

    This account was never late and paid off before filing. So why is it in the hands of a CA and why are they requesting this info?

    And, in case it has any relevance, I intentionally paid them off before filing, but it was less than the 600 preferential (maybe around 500 and some change over a three month span).

    Can anyone shed any light?

      It is a misconception that you will be discharged 60 days after the 341.There are too many reasons to list as to why and how it can go longer. Some BKs continue for a year or more. A lot of them are cut and dry, discharged after 60 days, not all.

      As for the OPs question, did you file with an attorney? Tell them you would like to dispute it. If you paid the debt in full, it shouldn't be with a CA. Contact the CA and request them to verify the debt. Just a few ideas.

        60 days unfortunately is not a rule. Can run longer just due to how backed up they are. They didn't even start counting my 60 day clock until 10 days after my 341.

        Yes, I have an attorney. I just checked the creditor matrix and see that they were notified today.

        The notice doesn't say anything about owing them any amount, just that they are a creditor and want the notices... but this should not be with a CA.

        I did not include them in my petition because they were paid off.

        I guess I will call the CA and then the attorney tomorrow.

          The CA may not speak with you, they may only talk to your lawyer out of fear of violating the stay. Contact your attorney, it just seems a little weird. How could they be a creditor if you don't owe them anything. Strange.

            Oh, I figure the CA will say they won't talk to me, but I intend to try by telling them that they are not actually a creditor. I'd rather not get the attorney involved if I don't have to cause I don't want to rack up any fees...we'll see.

                They did close the account a few months ago. I don't care about that.

                I was worried about my PayPal account period as I run a business on eBay and didn't want anything to affect my ability to accept payments. Did I have to? Maybe not, but it is in the user agreement that if you BK on any of their affiliates that they can close your account. I didn't want to take that chance.

                    Seems like California BK Court must always take a while. I filed Central District like Pakettle I am in an "awaitting discharge" status for 41 days now. I just called the clerk and she said the only thing she can do is forward my case to the judge office for a quicker review for closing.

                      It is weird but similar thing happened to me where my state IRS wanted notification. I didn't owe them or bk them either. I just ignored it.

                          I understand. I was just wondering if GE Money Bank did this themselves in your case of had a collection agency do it. That's the part that baffles me.

                          I did call GE Today. Well first I called Paypal Buyer Credit and asked them if I had a balance...they told me no. They said they couldn't get into my account any further and told me to call GE. The guy talked to me for awhile and told me the account was closed, blah blah blah. Yeah I knew that...that wasn't the question that I had asked him.

                          I wanted to know why it had been turned over to a collection agency. He put me on hold and then came back and said to have my attorney call. That was expected but since I don't owe them anything, how can they be violating the stay?

                          Anyway, I looked at the last credit report I pulled up and it is marked Paid Satisfactorily so I guess I won't sweat it. But I do find it curious.

                            You're not late yet at 41 days. It's when it starts to get much after 60 that you can start to wonder (but not unnecessarily worry). I filed Central District too and am way over 60.
