    List of Creditors question

    Hiya everyone,

    I'm getting ready to file this Friday pro se and have a question about the list of creditors.

    On my credit report I see the collection agencies, partial account numbers (1234XXX) the balances and the open dates. Nothing about who they are handling the account of behalf of.

    Do I have to call them all to get this information? Or can I list the collection agency as the creditor?

    I did a search and couldn't find anything already addressing this so forgive me if this question has been answered before.

    01/27/09 - case dismissed and closed - 02/24/09 - case reopened and dismissal vacated
    04/01/09 - new 341 scheduled
    6/02/09 - DISCHARGED!!!

    Just list those collection agencies, and the account numbers that they have.

      My attorney advised me to list the original creditor and the collection agency, because collection agencies are known to sale the debt to another junk debt buyer during your BK. Two collection agencies that I have listed in my plan have already sold to other collection agencies.

        Thats my concern, that by the time we file they have sold it to a new CA and we don't have that info. Are we still liable if that happens?

          Also, very important, if you don't recognize a creditor, or you believe the balance is wrong (on your credit report), make sure you check "DISPUTED" on Schedule F.

          So long as you list the original debt, you don't really need to worry about the JDB and subsequent sales of the debt. You need to concentrate on who and what you owe... not who may have or will buy it.

          Credit Agencies I always make sure something indicates that it's a Credit Agency.

            My attorney listed both the original creditor and the collection agency.
            Filed Chapter 7: 8/13/08
            341 Meeting: 9/15/08
            Last Day To File Objections: 11/14/08

              Thank you very much for the replies. I guess that means I need to call the numbers listed to find out who the original debt belongs to. I hope I can just ask without having to give all of my information for them to harrass me all over again.
