    Met with legal aid office today

    Just want to let everyone know what happened.

    My main reason for filling is a judgment, but I also have other creditors calling me constantly.
    I am kind of relieved that the law clerk who works there accepted my case, at first, he was telling me you are judgment proof, but then he changed his mind and said he would do it. I provided him with copies of all my bank statements, including my paypal account, I wasn't sure if they needed that, but just to be on the safe side I did. He waived the fee for the pre-bankruptcy certificate, but said that I might have to pay the filing fee and that they have installments, for some reason, I thought the filing fee would have been waived, but anyway..

    I am kind of confused about one thing. I just started the job I have now in Dec '07, I work from home, he said I might have to file for that year. I told him I didn't file because I didn't make more than $400 because I just started, so I don't quite understand that at all. Is this going to affect me? Of course for this year I will be filing in '09, I'm just so confused about last year.

    As I said I feel kind of relieved, but at the same time I am so scared, wondering if during this time before the filing if my bank account will be frozen.

    The thing about filing tax returns, is just that the Bankruptcy Code requires you to file one for or the most recent tax year ending immediately before the commencement of the case and for which a Federal income tax return was filed. The code also reads, further down that the return must be required under applicable law.

    So, since it's under $600, you are not required to file.

    However, your lawyer is probably just playing it safe.
