I am sorry to be asking all of these questions but I am up all night sick to my stomach and don't see my lawyer for like a week! So I was wondering how the automatic stay works. If I am keeping my car and house do I still need to make those payments during the stay? Or does it just pick back up after I reaffirm? When I reaffirm do I owe that back payments? I am so confused and sorry if it is a stupid question. I am only like 15 days behind on the 2nd mortgage and not on my car...

you should be making payments on any secured property you intend to keep during and after your bk. the automatic stay means that none of your creditors can solicit you for payments. you'll have to make your payments likely without the standard monthly bill or statement, as sending those is in violation of the automatic stay.

On any secured property you wish to keep you have to keep making timely payments throughout the bankruptcy. They cannot legally send you a bill though. However you can call them and get the amount and address to send the payment to. (Some will send a statement that looks similar to a bill but not all do that). You can contact them even though they can't contact you.May 31st, 2007: Petition Filed by my lawyer
