    Property Tax Dischargeable?

    Hi all, Well I finally files last week. Man talk about nerve wracking !!! My attorney said that my property tax MAY be dischargeable. I paid half of my property tax last April using a credit card. That is no more an option so I still owe for Oct. Can anyone shed some light on this for me? Should I be worried about this? Living in Wa. State btw.

    If you are keeping the house you have to pay the taxes.

    If you are leaving, the taxes will have to be paid by the next owner.

        Then you have to pay the taxes, for sure.

        If not there will be a lien on the place, and that wouldn't be a fresh new way to start life post- BK. Maybe try contacting the local assessor to argue their assessment, and therefore maybe have your taxes reduced? The process is ungodly and ridiculous, but then again, so is BK!

          Thought i saw somewhere that property taxes paid with a CC, then the CC debt would not be dischargable.
          Stopped Paying CC's 2/2009. Retained Attorney 1/10/2010 Filed 1/23/2010. Discharged 5/19/10 $187K CC, $240K 2nd,$417K 1st, No asset Ch-7

            Wow...just never stops does it !!! Ok so even though I had to list my property taxes as a debt am I allowed to contact my state and ask for a payment plan while my BR is in process?

              Yes, you can. Just like someone would list student loans on their bankruptcy petition, they are listed but not dischargable. Property taxes, since you are keeping the house, still need to be paid by you.

                What about paid with a CC, and you want to discharge the cc debt ??

                  If the credit card company doesn't file a claim against it, then it will be discharged with the CC debt. The charge was made 7 months ago, I doubt that the cc company is so ontop of everyones purchases to realize that it was actually property taxes that were being paid. This is probably why the attorney said it MAY be discharged. I beleive he was speaking of the April payment.

                    Actually she was talking about the current tax owed. She said it may be too soon to discharge it but it also may be possible. I wasn't aware that paying taxes by credit card may not be discharged even though it was 7 months ago. But then again BR wasn't even a consideration back then.

                      I don't beleive she can get your current property tax owed discharged if you plan on staying in the home. I don't know what her plan is to try to make that happen, doesn't seem likely to me. If she thinks she can do it, let her try. Worst case scenario, you will have to pay the taxes anyway. Doesn't hurt to try.
