    Question

    So I just got back from my lawyer's from filing. I don't feel like he is giving me any direction so I have no idea what happens now. I have $100 in my checking and he said that the trustee could potentially take it because he used my $2500 exemption for my tax return I will get next year. My direct deposit goes in on Fridays and that is over $500 and I told him this, so he said he would try and have me filed by Friday. Do you think it is likely the trustee would take my money? What happens now? Do I get something in the mail saying when my 341 is? Also, the $100 i have in my account right now, can I spend that on things like food and stuff?

    Also, can I continue paying on my student loans or will this be considered preferential? I just dont want them to go after my cosigner.

      Since your entire exemption is spoken for, I'd pull that $100 out today, and yes, food would be a great use for it. You will receive a notice in the mail about the date of your 341. Sorry I can't help with the student loan question, which sounds like an excellent question to me. I would absolutely not hesitate to add this to a list of unanswered questions and call your lawyer's office. You're going to need to stay in touch anyway, because "he'll TRY to have you filed by Friday" really isn't good enough.

      I know you're probably feeling exhausted and beaten down and worse, but try to remember that you are paying your attorney (a LOT, probably) to represent you, so while you don't want to bug him every ten minutes or call every single time a question occurs to you, you certainly are entitled to have your questions answered, especially when it's a matter of potentially losing an entire paycheck. Don't be apologetic or timid about this...once the paperwork is filled out and signed, which you've already done, they told me it was a matter of about ten keystrokes for them to actually submit it online. Make sure it happens!
