Im filing for chapt 7 in December. I owe Best Buy $60 because I bought a wall mount for my tv. My lawyer said something about HFSC or whatever the bank is that the BB card is through, that certain things you buy at BB are "secured" and they will request it back. I had to agree to give it back if asked, to my lawyer. I told them "If Best Buy wants my used, marked up, tv mount back - they can HAVE IT!" Its only $60, in my case.

If it were me and they wanted a computer back after I filed and was discharged, I wouldnt even respond. I'd use their letters as coasters, or maybe extra lining in the kitty litter box.
    Retained bk7 laywer 8-12-08, Filed 12-22, 341 Meeting Scheduled 1-29-09
    Discharged 4-17-09!!!
Reason for filing: Medical, NOT irresponsibility with credit.

I say ignore them, they don't want your computer, they want your money. The debt IS discharged and I read that they sent you a letter, but didn't file an objection as far as I can see. Ignore them and they will eventually go away. $700 is ridiculous when the original purchase price was less... and a year plus old computer is worth nothing to them.
Disclaimer: Young, NOT Dumb.(._.) The plan: $480 monthly for 60 months at 100%. 07/12/08
      Motion to Discharge: FILED!! 08/07/13
      60 down/0 to go \m/(*.*)\m/ 100% complete!

When I met with a lawyer he said that bestbuy is a secured credit line that cannot be in my bankruptcy.

This is a problem for me cuz I already have the 3 loans with a credit union , one of which is my car which I need.

Lawyer told me I would need to hand over my laptop (apple) and ipod n stuff AND it would not be discharged even though I am almost certain a Chapter 7

ANything I can do? looks like I am doomed. I am a chapter 7 but cannot come up with money for lawyer AND most my debt will not be discharged!!!!

        what do I do?

I have two laptops that was purchase on my husbands best buy card. My attorney has already told us that we will have to give the laptops back. Actually she asked us if we wanted to keep them or not. I'm not keeping them because they are half broke anyway. Computers are a dime a dozen these days.

Thanks everyone for your response; This is what happened:
HBSC attorney sent a letter to my attorney about one week before my ch. 7 discharge, they want me to pay $700 for the computer that I bought last year for $599, I guess they added in the warranty, I told my attorney I WOULD NOT pay the money. I NEVER SIGNED a reaffirmation. My discharge was 10/6/08, yesterday I received a letter from the HBSC attorney stating they know my case is discharged and asking for contact info for the person that would surrender the computer.

I called my attorney and he said the the computer is secured, so they can come and get it, that I can make an offer to them if I want to; and that is when I came to the board to get suggestions. I did give the computer to my son, he don't know I filed so I would have to tell him I have to give it back, I'm sure he would wonder why but I'm not paying them a lot of money to keep it. They did contact my attorney before the 60 days was up. The most I would offer is maybe $100.

Contacting your attorney before the 60 days is up has nothing to do with formally objecting to a BK proceeding.

This might be the time to have a talk with your son, depending upon his age. If you are truly prepared to surrender the computer, then you can do your best negotiations. If they decide to collect the computer because you can not come to an agreement, then do as all the others have suggested, wipe the hard drive clean and GO BUY ANOTHER COMPUTER.

(just a little off topic note - about 4 yrs ago I bought a flat screen from Best Buy and rather than using a cc I decided to use a cashiers check. When I got to the window to pay I got a really nasty look and nasty reaction from the cashier. Never knew why. Now that you are posting this info about the computer, I know why. With the cashiers check I destroyed their security interest!!)
