    Tax Liens were filed before my discharge!!!!

    Does anyone know how long it takes for a tax lien to show up on a credit report? Turns out, there were liens filed on my house before my chapter 7 discharge and a couple before the case closed!!! That burns me up. I'm speaking with my atty. now, but he informed me that if they remove them, the will just turn around and re-file them so it won't matter. Why even have the protection of the Automatic Stay if they do what they want anyway?

    2 were filed April 20th (this one probably won't show up on my report since it's been a while)
    2 were filed August 29th (this was the IRS - I'm really worried about this one, but its been almost 2 months since they filed the liens)

    I checked my credit report on myFico.com 2 days ago and still nothing is on it yet. I'm getting really tired of being scared and broke all of the time and I'm really thinking about walking out of that "lien" pit and letting them have it. Knowing my luck, they will just laugh at an OIC. Why does it always seem like when I take one step ahead, I take 4 back?

    I was just getting excited about my credit scores going up a little, now this happens. If I walk away from this house, I'll never be able to get another one with the housing market in the shape it's in right now. Life sucks!!!!!

    This really should not come as a surprise since we are talking about tax liens, the BK was never going to stop the filing of the tax liens. As I recall, you are paying these taxes in a subsequent chapter 13, so the liens will come off the house eventually. I suspect the liens will probably hit your credit report before the end of the year.

        I just figured I would have time to figure out how to make the Chapter 13 work before the liens were filed. And I thought if I were in an active bankruptcy, they would at least wait until the case was closed. It still sucks!!!!

          That does just suck! I don't know about you, but I'm finding that there are all these loose ends that keep popping up right and left after discharge. My advice to anyone going through BK is to be prepared for unexpected expenses after discharge. For example, the $255 utility bill I'm being extorted into paying because the energy company kept the utilities on at the house we surrendered. It feels like just when you have two nickels to rub together someone is there to rip them out of your hands!

            As far as the utilities go, it's your responsibility to call and cancel them. I kept the utilities on at my former residence until the Chapter 7 was final. I didn't want to be responsible for any pipes breaking or anything of that nature. Once the Chapter 7 was discharged and closed I called and shut them off and paid them in full.

              Hi Southernbelle
              Sorry to hear the news! I'm waiting anyday for a tax lien. I don't even own a house or diddly squat and I owe 50k. When I talked to them last time they put me on hold and placed a tax lien on me once I told them I was filing BK. I have to call them again before 10/25 just to check in and let them know where i'm at w/my BK. I am going to do an OIC as well - that should be real interesting : )

                Help did call and cancel..there's a separate thread discussing the utility co's failure to follow through:



                And I agree...just when you think things are over and done with post BK, you get kicked in the head again. It's almost like a divorce..after mine, it took a good year or so for the dust to settle.

                  Yes, I know that, and I did call to disconnect the utilities in the spring. They did not turn them off and now I have to pay the bill.

                    As for the tax liens, it's not a given that they will appear on your Credit Reports. I unwittingly discovered 3 state tax liens (from 2002) on mine when I pulled my reports the other day, but only on one (Experian). Mercifully, TU and EQ are lien free. The way I understand it, neither the IRS or the state goes out of their way to report to the CBs...it's the CBs themselves who are responsible for this indignity.

                      B_Girl I hope you are right, were your liens from the IRS? I'm hoping they don't show up because I'd like to rebuild my credit, but it seems like its out of my hands at this point. I guess I'll check again at the first of the year to see what happens with that. Like Help said, these are the loose ends that keep popping up all over the place.

                      The thing that makes me angry is the fact that most people look at our credit reports ONLY and nothing else. They don't take into account that we might have had a string of bad luck or made a couple of bad business decisions. Character counts for nothing.

                      Does anyone know if the liens will automatically drop off of my credit report after 7 years if one is filed or does an IRS lien stay on until the statute of limitations expires?

                        In researching my situation, I did read that the IRS doesn't report to the CBs, so if the liens do appear, you know that it was the CB who went to the trouble to dredge it up. As for the length of time it will show up on your CR, there isn't one date listed on mine--unlike the Bk, when the month and year it will drop off is clearly given, there are none for the liens! I have read they can linger for up to 15 years EVEN if paid. As a matter of fact, one of my liens is a duplicate of one that was released in 2005 and yet, both still appear, with no end date in sight.
