    Question about Salary Increase

    Hi everyone, I have an appointment to file Ch. 7 on October 28. I make $38,000 salary right now which is below NY's median of $44,000. If I was to start a new position making between $46 and $50k, what would happen? I probably wouldn't start this job before filing, but I may start it before the 341 and before the discharge. Would this be bad and force me into a 13?

    On a side note, when i did my pre-bankruptcy counseling online with my lawyer, it was showing that I have $400 left over every month. He said that it is still a chapter 7 though. Are these the numbers that the trustee sees or does the lawyer fill something seperate out when he files my petition?

    Your lawyer will fill out schedules I and J to come up with your dispsoable income. What does that show?

      I don't think he has done that for me yet, does he take those numbers from the online credit counseling? Or does he just ask me for them?

      Has anyone had any experience with the increased salary question above?

        Your lawyer will ask you for the info. Your credit counseling "adventure" has absolutely nothing to do with the means test.

          I had a salary increase for both me and my wife, and we were already over median. For us(Missouri) it mattered more are you sure that the increase is going to happen? Since we were sure(DW had a contract, state annouced a raise) we just put that down under something like anticpated increase in income. My lawyer said I can get a job after the 341 and it makes no difference at all.

          I guess you can always say that if you're in a a right-to-work...or something like that(they can fire you at any time w/o notice) that you weren't sure that you would have the income until you started the job, so you could secure it and then start after the 341. Kinda shady, but I don't think it's fraudlent. One of the mods or someone with more experience can tell you more.
