    What do you think about this??

    Ok, so when i hired my attorney i asked if he attends the 341 meetings. I was told yes, unless he has a court case. So ok i hire him and pay him in full. He files for us and then we go into his office to ask a question and I say well i guess next time we see you it will be at the 341? His paralegal was in the room and says no, mr. XXXX never attends 341s. I said, what do you mean? And she says we have another attorney stand in for Mr. XXXX. I said well i was told that you attend them unless you have a case. He says I never attend them. I am sooo f***** pissed. I paid ALOT of money to him, well over 3500.00 and now he says he doesn't go. So how is this other attorney going to know my case inside and out and know about all the s*** that i spoke to my attorney about? I am on fire...... What the hell? Is this right for me to be pissed or is this the norm? Do most attorneys not attend there clients 341? Its like Dr. Jeckel and Mr Hyde. Hes all about everything until you pay them and then they change.

    First thing is I believe 3500 is way to much to pay for a chapter 7 bk. But yes you should be mad he isnt going to attend. But really there should be no problems if he fills out the papers correctly and you are not trying to hide anything from the court.

    I filed prose myself and everything went fine. But I did see one attorney at his cost was 1,000 including court cost. The average fee around here is about 1300.

      I specifically asked my attorney if he was going to show at my 341 (when it eventually happens) because at my CH 7 hearing back in the early 90's, my then attorney didn't even show. The judge was PO'd and told the court clerk (or his assistant?) to send a letter of admonishment to the attorney. I went through the meeting on my own.
      Filed CH13 12/31/08, abandoned March 09 after losing job.

      Ch7 Filed March 2010. 341 Meeting April 2010. Discharge and Case Closed July 2010.

        I know now that I paid alot by what others have spoken about on this forum.

        I am not hiding anything, but I mean gesh.... least he could do is show up for 3500.00 bucks.... I could of filled out the paperwork myself. Well, you live and learn.

          I don't know that I'd be angry that he doesn't go to 341's; a lot of them don't, and send junior partners instead.

          But I'd SURE as hell be angry that he lied to my face about it. If he never attends 341's, then certainly he knew when he was nodding and smiling at you that he wasn't going to be there.

          In the end, I don't know that it will make any material difference to you since attys don't do much, if anything, at 341s: the trustee is questioning YOU and generally the atty doesn't say a word beyond hello. But I would be very pissed that he lied, so much so, in fact, that I think it might be best for me NOT to have to sit next to him at a 341... or anywhere else.

          But that's just me. Good luck!!!

            You can't really base that judgment on what people post on this forum. Each district is different. It's a tad high, granted, but not wholly unreasonable.

              I would be a upset as well, but seeing that it does happen often I'd let it go. I'm sure it will be ok.

              9/10/08 - 341 Meeting - It went great
              11/10/08 - Last day for Objections
              11/12/08 - Discharged & Closed!

                If you read my post about my saga, my Ch. 7 will cost $3400 and that's with a $500 means test included because I make too much money. If you're not doing a means test, $3500 does sound like too much money.

                  I think it's actually pretty rare that the attorney who prepares your bk is there at your 341, especially if he files a large number of cases.

                  That he told you he'd be there is very wrong. I'd make sure he isn't billing
                  you for being there and if he did, get a refund.
