    Help

    Hi all, I just paid my attorney in full this morning. Now I asked how long until they file and she said that the file thru the computer. Now am i suppose to make sure that my checking account is as close to 0 as possible when i file or the day of the 341?

    The day you file. And it should be close or lower than what you had on your schedule that you claimed it was.

      when do they ask you that? Is it before they submit it?

        I"d email your lawyer and get a time estimate tell them you want to be sure the checking is low as can be, they should understand.
        May 31st, 2007: Petition Filed by my lawyer
        July 2nd, 2007: 341 Meeting Held
        September 4th, 2007: Discharged and Closed.

          It has to be on the day you file and you will either have to get an ATM receipt or your bank statement, just in case you have to show it at the 341. And it has to be close or exactly what you have on your Schedule.

              They ask you when you fill your papers. My atty also asked me three days before he filed for the balances in my accounts and made sure it fit in my exemptions.

              I agree, call your lawyer!

                My lawyer had everything all set up and ready to go, so that as soon as I called his office and said my bank account was empty, they hit the "send" button. It worked perfectly.

                  Maybe this is a silly question, but what is the point of this? Can they tell what is in your account that day or will they require proof? There isn't anything in mine anyway after paying bills, but I'm just curious.

                    Since you must have overlooked my post, they can tell because they can ask for proof. You have to either provide an ATM receipt from the day you filed or the bank statement.

                      Your petition tells them how much is in your account the day you filed. If they ask for proof that the amounts on your petition are correct, then you better make sure your bank statement shows that the accounts have no more money in them than you put on the petition.

                      One common mistake is writing checks to pay bills and feeling like the money is spent. But the checks take time to clear your account and the money sits in your account waiting. It's far better to go get a Money Order so the money is pulled out of your account immediately than risk waiting for a check to clear.

                      Any money in your account that isn't listed as exempt on your petition is fair game for the Trustee to take -- even if you already wrote checks against those funds.
                      Discharged November 2008 100 days after filing no-asset Chapter 7. We intended to let a two-year-old vehicle go back to the bank and reaffirm an inexpensive ten-year-old SUV and our home mortgage. In the end we surrendered ALL of our vehicles and reaffirmed NOTHING. We'll "ride through" our mortgage after the court ruled it an undue hardship.

                        Just simplify this. Go take everything out but $5 and pay everything with money orders. Problem solved.
