In simple English: Can a company who lent you money for a car deny your reaffirmation?
I have been 'current' on my auto loan with Chase Auto Finance (short history prior to filing bankruptcy, and the used car was financed/loaned a month prior to bankruptcy). My attorney said I should simply request the reaffirmation agreement from Chase and fill it out; it's just a matter of paperwork.
I can't think of a reason why Chase would want to deny reaffirmation and take my used car. Anyone?
One added point: while only I am filing Ch7, my wife is not. She is listed as a co-signor on the loan. So, correct me if I am wrong, even if I fly off to Aruba for the next 20 years, they'll hunt her down and make her pay.
Any thoughts?
