    Reaffirm auto loan question

    In simple English: Can a company who lent you money for a car deny your reaffirmation?

    I have been 'current' on my auto loan with Chase Auto Finance (short history prior to filing bankruptcy, and the used car was financed/loaned a month prior to bankruptcy). My attorney said I should simply request the reaffirmation agreement from Chase and fill it out; it's just a matter of paperwork.

    I can't think of a reason why Chase would want to deny reaffirmation and take my used car. Anyone?

    One added point: while only I am filing Ch7, my wife is not. She is listed as a co-signor on the loan. So, correct me if I am wrong, even if I fly off to Aruba for the next 20 years, they'll hunt her down and make her pay.

    Any thoughts?

    They can, but it's not to their benefit. I've never heard of a company not accepting a reaffirmation...as long as the payments are up to date.

      Just continuing on the theoretical... let's assume a company was to deny a reaffirmation, but the loan had a co-borrower. Would it even matter?! Just because they denied the reaffirmation, I would think the co-borrower woudl still be on the hook.
