    What happens if.....

    With a clearer head, I've reread the numbers on my petition about a dozen times. and I've found two errors. One I found the day before my 341 and told the trustee of the mistake during the meeting and I found the other this weekend and told my lawyer.

    My means test now shows me at -18 instead of -118 and my schedule J shows me at $78 instead of $18. What happens if the UST objects to something and it puts me over (my cushion is not as soft as it was before).

    I was told if there were going to be any problems with my petition, the UST would have brought them up before the 341 and to just calm down and stop looking for things to go wrong. I'm afraid with 2 mistakes, they'll take a closer look even if they hadn't planned to before.

    6 weeks and 2 days for my 60 days to be up.

    Oh, since I refuse to sign up for pacer, would anything and everything come to me by mail that would be posted to it?

    Trust me, the courts and trustees aren't going to care about this tiny difference. You have to show at least $125-175 disposable income a month to have any chance of getting pushed into a Ch 13. You are still well under this.

    You need to get this process into perspective. There are THOUSANDS of bankruptcies filed every day across the US. The trustees aren't going through every file in any detail unless something that indicates a lot more income or hiding of assets than these two tiny errors shows up.

    This isn't like the IRS with your taxes where they go over the forms with a fine tooth comb with no room for error. There's no time and no resources to go over every single filing like there was a million dollars hiding in there. It takes something big to get your file pulled by the US trustee. This isn't even close.

    Yes, anything important to you that's posted to PACER is also sent via US Mail to the mailing address listed on your forms as well.

      Thanks.

      As for pacer, I know myself, I'd be checking several times a day. Once I check my mailbox, I know there isn't any point in checking it again :-)

        I found a mistake in my potion that could have gotten my case dismissed so I am glad I signed up for pacer

          Good point. I was thinking anything on there my lawyer would handle. She is a trustee but I'm thinking I need to get a little more involved on tracking this stuff.

            Yep, I would logon to pacer too, just too important not to.

            I agree, those numbers are small..... no worries. I keep telling myself that the little numbers that have changed since filing mine are OK too, so I understand the stress!

              If you had a lawyer like ours, you couldn't afford NOT to check PACER now and again. Just be careful.

                Stephen - I have/had your concerns too, but I think lrprn put it in wonderful perspective: there are THOUSANDS filed daily... As hard as it is, try not to worry about it. Even if the error was there and could be fixed... errors do happen. Not the end of the world. As long as you were honest; Trustees are human, they understand so long as you have a legitimate case...
