    When to file chapter 7

    Ok so I'm really about to call an attorney and file chapter 7 bk. It's been really tuff lately. However, can I file ch 7 if I recently used the credit cards?
    I have the following:

    citifinancial $9,990 (it's a flex line)
    Wamu $8,900 crdit card
    USAA $11,000 crdit card
    USAA $7,000 personal loan
    Discover $500
    Total debt: $37,500

    I have a current car loan for $19,500 I want to keep
    All accounts are current and in good standing status.
    I have been unemployed for 2.5 months.
    I just got a job that doesn't pay well but it's a job.
    Ideas?

    Don't file until, you can support yourself without using credit cards.

      Agree with keepmine and also, if you can support yourself (without the debt) stop paying on your cc's if you truly plan to file. But make sure you don't have over $100 disposable per month or you can get pushed into a 13.

      Edited to add - you need to wait 90 days or longer (depending on your charges) before you can file if you've recently used your cards.

        Disposable income of only 100 a month? Is that the rule for 13? vs 7?

        Or is that because of the amount of debt? I've never heard that before thats why Im questioning it.. Thanks
        Shoot that can change in a week if the gas prices go up

          You must have sufficient disposable income to finance a Chapter 13. Currently, the cutoff is $187.50/month but, that will likely rise next month when the adjustments to median income, etc. take affect.
          Good lawyers will try and keep you well below that number.
