    credit card use during bankruptcy

    Can you use a credit card that is not included in bankruptcy because it had a zero balance at the time of filing? I mean using it between 341 and discharge..... just curious....

      Nope.

      Keep in mind, just because a card wasn't included in your BK, doesn't mean it will stay open. Also, the automatic stay effects all creditors, regardless if you included them; thus, no creditor is supposed to extend you credit, nor are you to seek or use credit until your BK is discharged or the automatic stay is otherwise terminated.

        what if you are just an authorized user on a business account. I don't even get the bill I just have to turn in receipts?

          I had this question as well. I was able to get my business card through my employer, my name is on the card and I am able to use it. It wasn't an option for me, I had to have it to work at the job that I have...so if that is the case you should be fine, however different states may have different laws regarding this. I am in Ohio.

            I was given this card just prior to filing. Actually, when they called and solicited for this card I told them I was filing for bankruptcy the guy said "that's fine, we are giving you this card based on your history with us. We will not check your credit. You can use this card to rebuild your credit". As of right now the thing is open. Is it even legal to use it while in bankruptcy, I guess that is my question.

                Our lawyer told us no credit until discharge.

                  Is this a company related credit card or personal?

                  If company related there may not be a problem.... if personal, you are not supposed to aquire any credit during bankruptcy. It can cause to have your case dismissed.

                    Well, I didn't get a chance to use the C.C. Just got a letter in the mail today that said to cut it up and throw away! Pretty funny. When they called and solicited the credit card I told them I was weeks away from filing bankruptcy and the guy said "no problem! We won't check your credit report this is based on your payment history with us. You can use this card to rebuild your credit!" I guess he was lying........imagine that....

                      The thing is, that most major credit card issuers (and Banks) get notification of your Bankruptcy filing almost the instant it is filed (it happens overnight). Most of them subscribe to Credit Reporting Agencies (CRAs), who get very fast notification of the filing of a case.

                      Want to know how I know? I didn't tell anyone about my BK... filed on a Wednesday afternoon. I didn't even list this particular Bank at which I only have (well, had) a Line of Credit (Overdraft Account). Yep... Thursday by noon, it was closed and charged off, and the sucked the money out of my primary checking account! Talk about FAAAAAST notice. Some of these processes are automated and to protect the Bank -- well, at least that's what they tell me.
