    How do I Amend my Chapter 7 Petition?

    I am pro se in my Chapter 7 BK. I want to amend the petition. I found a creditor I did not list on my orginal petition. I filed BK on July 11, 2008.What form do I use to amend this? I filed in Middle District, Tampa, Florida? Thank you.

    Hi peppylady:

    Welcome to the forum. You said you filed pro se. Did you file by mail, or did you file by computer? In any case, you will need to get a new set of forms. Make sure the title reads AMENDED FORM, or some language like that, and fill in the correct information.

    If you can, take the correct forms to the courthouse and file them in person. To amend a petition costs $26.00 dollars, so take cash. You might take a money order, but in case the rules have changed like yesterday, I would take cash and some change.

      I filed back in October 07, was discharged in Jan. 08. Can one still amend schedules already discharged? My bk att recently amended her fees schedule, in fear of not getting paid. We've already paid 4,600.00 with an additional 2,400.00 billing. We think this is excessive as does the court apparently, in which we received a document requesting att. to show cause. Has anyone had this circumstance before? The clerk said it's customary to review bk docs. and question excessive fees. Our bk att has charged us by the hour since day one.

        Actually, I believe that you can take a copy of your Discharge Order and give it to the creditor. There have been a couple of other posters here and there with that question, and this is what I have gotten from reading their responses.

        I have the NoloPress C7 book and will research that first thing in the morning. I will respond ASAP. Please understand that we are 'entertaining' T.S. Fay, Thursday and Friday and I may not be able to respond as quickly as I would like to.

        Hang in there. I will get back sooner or later, and probably someone else will be able to respond sooner.

            i can't help but i can share my opinion, which is that those legal fees are outrageous for your average ch7 case (though may be considered reasonable if your case required attorney representation for adversary proceedings, etc post 341). If that is not the case, the trustee/bk court is definitely interested in these matters. consult the bk clerks and your assigned trustee as to how to report the questionable fees.
