    is it this simple?

    I met with several lawyers and they all seem to think my case is very simple. I have about 80k in credit card debt and no job, no house, no car. All debt on the cards is over 1.5 years old. In August of 2007 I quit my job (55k/year) in NC, moved my few possessions to my parents house in IN, and went to china for a year to self study. Tutored several kids in English for living money that amounted to several hundred a month but all in cash. All the lawyers I talked with said that as long as I used my parents address as my primary mailing address I could go ahead and file in Indiana without waiting and plan to show my income/expense as 0 and saying that my parents are supporting me.

    Will the truste object to any of this or is it really this simple? I turned in all the paper work and paid the lawyer who says it will take about 2 weeks to fill out all the documentation and then 4 weeks later I'll have my 341.

    Boiler, I can't ever encourage anyone not to be entirely truthful on their filing. Given that "a few hundred a month" isn't going to change your eligibility for Ch7, why not declare your income accurately? And personally, I would think twice about any atty who risked MY ass by advising me to conceal income. Other than that, your bk sounds very straightforward.

        Don't be in such a rush to blindly trust an atty. Be a savvy consumer of legal services as much as you would be buying a car or planning your investments: it could cost you a great deal more than you expect if you trust the wrong one.

        And BTW, if an atty advises you to lie to others, telling them what they want to hear, what makes you so sure he's not doing the same to you?

              The guy said he visited more than one lawyer. I'm assuming they all told him the same thing so why would you want to tell the courts that you were out of the country for a year and making money without paying taxes?

                The 1.5 yr old debt got my attention on this post, so I followed your link. LOL Seems like the poster erased everything.

                  Because it is the smart thing to do. What would happen if the court find this out and your case was dismissed?

                    As I told my kids a long time ago: I can tolerate anything but a lie. With the truth, we can fix it. With a lie, you're on your own.

                      I so agree, when you lie you have to remember the original lie and keep your story straight so you won't get caught lying. That takes way too much energy.

                        How many of you lied about your income when applying for credit cards? If you go through life playing by the rules then you will get taken advantage of by the guys who will stretch the rules.

                        Would you lie on a job application by omitting something you know would jeopardize getting hired? Do you stretch your write offs on your tax return?

                        When I had an interview 14 years ago for a company that was a stepping stone for me they asked where I see myself in 5 years? I guarantee no one interviewing wanted to be there in 5 years and I guarantee that if you told the truth you would not get hired.

                        There are times when you don't want to tell the whole story.....

                        I did not have sexual relations with that girl.....

                          One more thing. Should I have told the trustee that I had a job that would make 150K a year that starts 1 week after my hearing?

                            When a lie could jeopardize your whole bankruptcy case, making you responsible for all of your debt (plus possibly get you slapped on the hand by the court, with whatever consequences come with that), it just isn't worth it IMO. Lying is never a good policy, little white or big bad, no matter how well you rationalize it.

                              I see your point logan about a little lie.. However, when your dealing with courts & laws is it worth losing sleep and possibly your freedom by trying to hide the truth? Also, that would follow you around for the rest of your life if you got caught. Don't fret.. these thoughts cross through everyones head at one point or another.
