    Been discharged in June and received call from Nationwide Credit

    I was discharged in June (Chapter 7) and just now received a call from Nationwide Credit. I have no idea who these jokers are. I had checked my credit report when filing, as instructed per lawyer, and never noticed them. And I have a very good memory and do not remember them or sending bills to them. Anyone know who they may represent?

    I am worried. Although my only source of income is SS disability so they wouldn't be able to garnish that if they did go, so far as, seeking a judgment and winning it. I did NOT need this right not.

    Nationwide credit is a collection agency. They are typically used by AMEX or Capital One. After the cc agencies do their internal collection efforts they turn the collections over to one of these collection agencies. My favorite was NCO, who called me night and day (3-5 times a day) from 4 am till 10 pm.

    If you were already discharged, the chances are likely that Nationwide is trying to collect a discharged debt.
    6/11/08 - Filed Ch. 7, Filed Pro Se, No-Assets
    7/15/08 - 341 Meeting Held
    10/01/08 - Discharged
    10/08/08 - Case officially Closed!!

      If the original debt was discharge and then they sold the debt to someone can they try to collect even though it was discharged?

        They can "try" to collect but the debt was discharged and you don't owe it. They will always try and get more money out of you, but that's where you need to be an educated consumer. Send them a letter requesting validation of the debt, and "IF" they send you something, you should be able to match it to your creditor matrix and then send them the proof it was discharged and you don't owe it.

          I read an article about this recently...appears there is a market for discharged debt, and yes, they do try to collect, even though it is clearly discharged. Just say no.

            Thanks guys. And a funny thing is, Cap One is one of my creditors. I never even received any paper correspondence which makes it all the more suspicious. I also received a Cap One preapproved card in the mail today, in my old name which is how they asked for me in the message.

            So I'll just disregard them.

              Nationwide Credit is AMEX, they are Nazi's. It's just their collection arm. Send them a copy of your discharge and tell them to bite one. Send it certified mail and also cc your attorney. If they persist then take them to court. They will lose.

                I was sued by some company representing Sam's Club. I have had a card but never have we used it for credit. I called and complained and got a never used status. They eventually reversed this. I think a lot of companies phish for credit problems to scare little 'ole ladies to pay.
                If I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.

                  Since all your debt has been discharged you could just have conversations with these guys and waste their time knowing there losing money every second they're talking to you.

                    Nationwide is a CA from AMEX. Just talk to them and fax over your discharge papers. They are like sharks, you'd be surprised that people still pay debts that are discharged in BK because they are not aware that it can be sold to debt buyers who then try to collect.

                      When they call again as others stated, give them your bk case number, chapter filed, district, and discharge date. Give them your bk lawyer's name and number. Tell them they are trying to collect on a discharged debt in violation of the order by the court.

                      They can look up your case with that information. If necessary you could fax them a copy or mail a copy to them.
                      May 31st, 2007: Petition Filed by my lawyer
                      July 2nd, 2007: 341 Meeting Held
                      September 4th, 2007: Discharged and Closed.

                        Make sure you get a name of who called and document the time. If they continue to harass you, send them a certified letter with your discharge, and then pray they continue to call you, because then they violate FDCPA rules and that is $1k to you plus attorney fees.
