    When are reaffirmation agreements signed?

    We are reaffirming our cars. We filed on 8/5, when are the agreements signed?
    8/5/08 - Filed Chapter 7
    9/10/08 - 341 Meeting - It went great
    11/10/08 - Last day for Objections
    11/12/08 - Discharged & Closed!

    We signed papers in our lawyer's office before we filed. Her assistant also called our CU and thought everything was fine. We filed 12/28/07 so it was the end of the year, plus New Years and all that. However, we found out that our CU would not accept the lawyer's papers, it had to be THEIR paperwork, and it had to go before the judge in their district (another state). So our checking/savings account was locked for about 10 days until this was sorted out. But in the end, all was well. We reaffirmed the car--it will be paid off in March--and an overdraft protection loan.

    I would talk to the attorney, or someone in your bank or CU's BK department.

      We are keeping one vehicle and haven't signed anything and we filed June 5th.

        My attorney brought the paperwork to the 341, and I signed it moments before we were called up. I know, it sounds awful, but he was actually saving me having to drive an hour one-way to his office to do it beforehand.

        last day for objections: September 16, 2008
        DISCHARGED September 18, 2008 - CLOSED September 29, 2008

            Don't I know it, and believe me, if we were allowed to name names here, I'd be attaching his name and number to my sigfile! He is the best.

              After we filed, the re-affs started trickling in, slowly but surely....several arrived about 2-3 weeks after filing (they were from the same lender), the rest (from 2 different lenders) arrived a couple of weeks before the 341. We ended up only re-affirming one, so we returned the others to our attorney as 'rejected' shortly before our meeting.

                Oh yeah, I need to tell this story:

                One of our creditors with whom we did NOT want to re-affirm, tried sneaking an agreement in by sending it to our Trustee, all filled out EXCEPT for our signatures. He handed it to us at our 341, and said we needed to take it to our attorney.

                We did NOT sign, and that creditor--one of the most sorry companies we ever dealt with--is one that we were very happy to discharge.

                    We're keeping our house and letting our car go. We did not sign any reaffirmation papers for anything.
                    May 5, 2008 - Filed Ch7
                    June 13, 2008 - 341 Meeting
                    August 12, 2008 - Last day for objections... August 18, 2008 - Discharged!
                    August 26, 2008 - CASE CLOSED!

                      I contacted my attorney, he said he would mail me the reaffirmation agreements once he received them. He has notified the companies holding our car loans that we intend to reaffirm. He's just waiting for the paperwork.

                      Cool. One less thing to worry about.

                        I will add this thought: many people, from what I have read here, chose not to re-affirm because if for some reason they cannot make the payments, then they can walk away and not be responsible for the difference after the car is auctioned off.

                              We signed one of them shortly after the 341. The other got signed and filed on the very last day it was possible to do so, on day 60 after our 341.

                              As for finding a good attorney. We used the same one a friend of mine used (her parents also used him when they filed about 10 years earlier). He'd gone to bat for her over who counted as part of the household and won the argument (old law, she lived with her boyfriend). He cost me an arm and a leg but he was good.
