    how likely to be objected

    I wish I would have new about this forum before I filed!! I can see many mistakes I've already made and now I am just trying to learn as much as possible and be prepared as possible for anything that may come about. I have this one CC that I opened in 05/07 and didn't use until 01/08. Between jan to april I racked up $5000 in mostly what you would call luxury junk. $1500 was a down payment on my wife's surgery (in jan). Anyway, I've only made 5 payments on this card. I use quicken and I send them payments online. One month I accidently sent the payment to an OLD citi account. The next month I got the bill and the payment tripled with the late fees and the missed payment. On top of that the interest rate went from 10% to 30%!! I paid the huge minimum amount that month (like $330) and then made one more regular payment before filing.

    How likely are they to file an objection? It's been more than 90 days since I last used the card. If they do what are my options. Should I try to fight it? The main reason I had to file was that my wife had a new bill starting in march of $440/ month and then late in April my cars timing belt broke and it destroyed the engine. I bought a new car (2008 honda civic) a week later. That payment is $406/ month and my insurance went from $60/ month to $120/ month. So you can see our monthly payments went up over $900 in a few short months. Not to mention citi tripled their interest rate and the payment went from $80 to $180/ month!! Do you think I could fight an objection or would it be best to just try and work out a settlement??

    I have my 341 metting in 6 days and, so far, citi has not filed even a notice of appearance but in my gut I am expecting that they will.....I just want to be prepared for anything.

    Medical care is not a luxury unless it was elective surgery.

    It is unlikely they will appear if you didn't use the cards in the last 90 days prior to filing.

    Regular charges for gas, food, etc is not a luxury (unless say you ate at Mesa Grill or Emeril's on a daily basis).

    We are all afraid that we will have objections, most don't.

    If you have made errors or omissions in filing you can file amended forms.
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      I have not seen too many cases from citi pursuing cc debt. From the cases I have looked at, Amex seems to be most ruthless when it comes to pursuing debt. Therefore, I have transfered the most debt to these bastards

      It really is hard to tell whether citi will file a complaint. Worst case scenario, if they do, you can fight it or settle for a payment plan.

      Unless there is circumstantial evidence like you lost your job and then went on a spending spree, I think most people are safe.

        Debtor36K Just curiousity, what kind of car blew the belt and engine. I had a Dasher diesel once and it sucked the alternator belt that came off into the timing belt, and bam valve through the piston.

          it was a 95 honda prelude........

          I have a related link about citi reporting the credit agency that their debt is a charge off not IIB..... I think they are mad!
