+2...check with your attorney first (if you haven't retained one yet, I would check with at least 2 just to be sure )...this is just too important.

As regards bank statements, I was leery, too, about whether we would be asked for these, but our attorney assured us they would not be needed. We were the last ones to meet with the trustees the day of our 341 (there were at least 100 people seen before us) and none of the trustees asked for bank statements. But this is just the norm for our district....check with your attorney about what is the norm for yours.
    Filed BK (Ch. 7) 6/2/08
    Discharged!! 9/24/08
    Closed..the end! 10/1/08

The clerk's office or even the trustee/his or her staff is also an option for information (although I honestly don't know if you have an attorney if the trustee's office is open to speaking with you directly); I personally wouldn't rely on an attorney to "take care of everything" and would double check. But that's just me. ;)

I seriously wonder why there are so many discrepancies as to what one district wants as opposed to another. Some of us are asked for lots of detail whereas others just show their DL and SS card (and marriage license!!) and go on their way. I guess some districts/trustees have had a greater presumption of abuse, or have had people try to abuse the system.

The point is, though, that you can't get away from that (regulations/requests for documentation such as bank statements and such) short of moving, which isn't necessarily a good idea either, just to file in a different district. I have no doubt that some people do that, though, as well.

I've wondered that, too. Even taking into account that every bankruptcy is different and every debtor's situation is different, I've noticed in some districts with some trustees they say they never take anyone's stimulus check, that it's automatically exempt. Other places it's fair game. That's just one example.

You'd think there would be hard and fast rules about if it is or isn't. But then there I go...expecting reason and order from the government
