I took out a loan with well's fargo back in 1999 for educational purposes. I included it in my bankruptcy creditor matrix because I know you have to and I also assumed that the loan is dischargeable. I haven't even been to my 341 one yet but when I looked at a copy of my credit report Well's fargo has closed the loan, the balance is $0 and it says debt included or discharged in chapter 7. Account type: unsecured loan. My question is should I stop making the payments? Do you think they are going to allow it to be discharged?

I wouldnt stop making the payment. They might have sold the loan or if you had a cosigner it might have been put in thier name now. Possibly just an error, but 99.999% sure its not discharged.
Call them and ask.
EDIT: I think I misread the post, sorry. Please disregard the above comments as there is not enough info to make this conclusion. Did the bank know what the loan was for?Not only am I not a lawyer, the California BAR association has sent me numerous letters telling me not to even THINK about going to law school. In fact, the lay advice I provide is not even good. In the end remember, you get what you pay for, and here in BK land were not the best at paying.

The bills I get every month say Well's Fargo Educational Financial Services. I owe about $5000 more on it. I searched the internet about it and someone was saying how they discharged the debt only to have a collection company contact them years later saying they want the money. I think maybe they sell the debt off.341 meeting 08/18/08 :aggress:

Student Loans are nondischargeable.
However it would depend on the structure of the original loan with Wells Fargo. It is possible it is discharged.
If you filed with a lawyer I'd call and ask him.May 31st, 2007: Petition Filed by my lawyer
July 2nd, 2007: 341 Meeting Held
September 4th, 2007: Discharged and Closed.
