Well, I already got one. It is from GE money Honda card. It's a revolving credit card from honda motors that I used to buy a $5000 motocross bike with back in 2002. Wouldn't you know they put a lein on it! Anyway, I've never missed a payment since 2002. I've purchashed a couple other things totaling about $1500 of motocross gear which they can't possibly have a lein on! Total due on the card is about $3100(seems like about $1600 left on the actual dirt bike) .....Oh yeah, I wrecked the dirt bike into a tree in 2006 and sold it to a friend for about $500 who made a kick ass go-cart out of the motor. Obviously I don't have the bike anymore so what is going to happen? Will they accept a re-affirm for less and continue with payments? What are my options?

From what others have said on here, a notice of appearance doesn't necessarily mean they are going to show up at your 341 and object to anything. It typically means they just want to be kept abreast of any filings that pertain to our case.
We also got a notice of appearance\request for notice from Chrysler, even though we are assuming the leased vehicle we have with them.Filed Ch 7 - 07/10/08

Lots of places file these but seldom show.
If they do just be honest. That you don't have the collateral anymore. That it was wrecked, when wrecked and that you disposed of the remains. Invite them to come out to the premises to verify (or the trustee can send someone).
Things like that happen don't reaffirm the debt.May 31st, 2007: Petition Filed by my lawyer

We got a loan from American General for a loan to try to pay off some of our debt and stay afloat. Yea, bad idea. The collateral were two older automobiles. Long story short; one backfired in the driveway and caught on fire. About 8 months later the other one--which always had repair issues--broke down once again. When we found that the bill to fix it temporarily was more than 1K, 'Hub gave it to the mechanic for the cost of the estimate. All of this was duly reported to AG. They had the nerve to try to slip a reaffirmation agreement, by sending the forms--already filled out, EXCEPT for our signitures--to our Trustee before our 341. He gave them to us. We did NOT sign.Last edited by AngelinaCat; 08-05-2008, 08:45 AM."To go bravely forward is to invite a miracle."

Debtor36k I know the story on Mr. Singh. We got a lawsuit notice to include on our bk7, It was in regards to a long closed account with Sam's Club. I called Sam's Club as to why they thought I owed them anything and what amount was it? I had my old card long expired. The person told me I had NEVER made a charge on that card and I told them well, we both agree so why? She refered me to RMS and once I talked to Mr. Sengh, he agreed and appologized. He immediatly sent to PACER an order to remove his claim.
I think this company phishes for bk people and when someone believes they owe, they may either not contest and get money or pay something they do not owe. Be careful there are a lot of skalowags out there. 'HubIf I knew it all, would I be here?? Hang in there = Retained attorney 8-06, Filed 12-28-07, Discharge 8-13-08, Finally CLOSED 11-3-09, 3-31-10 AP Dismissed, Informed by incompetent lawyer of CLOSED status, October 14, 2010.

I landed sideways off a long double which immediately slammed into the ground and the bike cart wheeled off into a tree bending the frame. No permanant injuries but I had a baby on the way and it scared the life out of me. I stopped the sport after that.341 meeting 08/18/08 :aggress:

The baby is awesome! thanks for asking. He is nearly 2 years old and full of stubborness and hell raising. Anything I don't want him to get into, he's there. Oh, but what fun!341 meeting 08/18/08 :aggress:
