    Nightmare 341 today

    Just kidding! It was everything you guys said it would be and less. I guess its one of those things you have to go thru to believe how simple it is. It was honestly less than three minutes, probably less than two. The trustee actually had a "staging area" in which the person who was next in line would sit, directly behind the person being interviewed, to minimize "transition time" I guess.

    Even the people who you would assume would have a hard time (gambling problems, etc.) were done in less than five minutes. One lady didnt speak english, had an interpreter, and had sold 4 houses in the past year. She was saying that the houses were "sold" but some how they were still in her name, also there were now magically renters living in them, but the mortgage was not being paid. She didnt know where the default notices were going, didnt know who was collecting the rent money, and couldnt account for the money for the sales of the houses except for saying it went to "construction" and living expenses. Her meeting was about 12 minutes, complete with a UST that didnt look old enough to buy ciggs. When they were done questioning her they told her the 341 was done and no continuation would be neccecary.

    The trustee was a woman, which made me nervous initially. Turns out she was so nice, I cant believe she was ever a lawyer or a trustee. She even answered questions for me about my "executory contract" that I have spoke about in the past. This is funny because she didn ask me anything about it, I actually left when my meeting was done, came back, and started explaining to her about the executory contract (dumb right?). I told you I cant leave well enough alone! I just thought maybe she would see it later and have questions, so i decided to talk to her about it.

    If I had to compare this experience to something, it would be baggage check in/security check at an airport. "Has this bag been in your posession the whole time?" I think McDonalds might be more intrusive than my trustee, "How dare you! what do you mean by, do i want fries with that!" She was great, and made everyone feel comfortable (even let some guy who forgot his ID pass without continuing the 341).

    No one got asked for any documents, unless they were docs that were not filed (tax form from last year, missing schedules).

    One creditor came and asked a lady if she was gonna reaffirm her jewelry, she said no, they asked if she had it, she said no. OK, no more questions, bye have a nice day

    ok BKpara you were right. but nobody who hasnt been there wil believe me either.

    Lastly, even if she didnt uncover anything I think she made some good money today (at 60 bucks a pop).
    Not only am I not a lawyer, the California BAR association has sent me numerous letters telling me not to even THINK about going to law school. In fact, the lay advice I provide is not even good. In the end remember, you get what you pay for, and here in BK land were not the best at paying.

    I feel for the other poor poster, I forgot the name, but she seems to have been the *unlucky* 1 % that gets audited, and about a wedding ring that is broken, yet.

            Anyway, I think you are right, people (me) are going to be scared, it's natural. You have to 'experience' it on your own.

            I glad everything went well....congrats!

                Glad it went well.

                We had a lady that couldn't speak English too.

                That staging thing, would have gotten on my nerves fast.

                      That's great! So glad all went well and that nothing was said about your "lack" of representation. :P I think you did great and were a better guardian of your own future than any attorney.

                        To be honest I consider myself discharged already. I think Ill check pacer once a week to make sure they recieve my debtor class stuff, and to see if the auto company has filed for relief of stay, but thats about it.

                        I cant imagine the trustee asking me for anyhting else, given my finacial postition, and the creditors a pushing in line to see who can disavow all knowledge of me first!

                          Its funny because like half the cases were told to go file amendments after they were done, and they were only cases with lawyers. Some had to ammend almost all thier schedules and thier 341s were continued. To be fair all of the "messed up cases" had lawyers that were absent, shows how commited they were in the first place. About a third of the cases were pro se (although im the only one that didnt use a doc preparer) and all went off without a hitch (except the old lady with all the houses, she could have actually used an attourney).

                          The people who used document preparers got a couple of extra questions directed towards them as well.

                            Thank you everyone for all the help and encouragement BTW. You guys are a big reason it was so smooth.
