    10 days and counting...

    So my 341 is a mere 10 days away, and I've read on here how almost everyone was required to produce bank statements and other various docs before their meeting. We are above-median and have not heard a peep from the trustee, and the only docs we have ever submitted was pay stubs and tax returns to our attorney a couple of months ago (no bank statements ever). We received a letter from our attorney last week and he mentions that they have all of the docs that he needs.

    Does this sound normal? I am very surprised that I haven't been asked to produce any bank statements as of yet, but I have every document I can think of ready to go in case I am asked.

    I think every Trustee is different. Mine asked for bank statements, paystubs and tax docs already provided through my atty, but my Trustee was extremely thorough. I hear that if I would have gotten one of the other 2 chapter 7 Trustees it would have been a different story because I hear they are really laid back.

    IMO, it all depends on the Trustee in your district.

      Thanks...our attorney described our trustee as being a "a skilled and experienced BK lawyer, and a diligent trustee", and but one that has never given him any problems. So I was expecting to have to produce all sorts of documents before the meeting.

        I wouldn't let it keep you up at night. If the Trustee wants extra info, then make copies and have it with you at the 341, but if not, it's easy sailing. Answer yes or no at the 341 and you're done.

        If it helps, my Trustee mailed me a list of items to bring to the 341 about a week after I filed so I wouldn't expect anything from yours this late in the game. Good luck.

          It is different in different districts, so it is possible in yours he doesn't need more. I hope its smooth sailing

            Hey laurannm - Our 341 is the day after yours. Same here - no special requests so far from the trustee. We did get reaffirmation agreements in the mail, but don't think we are gonna sign them. Still undecided on that.

            I am just sooo nervous! I see all the stories of how easy it was for most people and I do have hope - but then my life is usually more like - if something can go wrong, it WILL!

            The stomach cramps have started back again and my face is breaking out something awful! I am just a stress-mess. Hope I can get some sleep the next few nights. Just want it over, ya know?

              I hear what you are saying...we are dying to get this over with. Hang in there though...I am sure it will be fine for both of us

                  Hey goodluck to both of you. I acutally was getting stomach cramps reading your threads. I haven't filed yet and cannot imagine going to the 341. YUK.... It makes me sick just thinking about it. I have IBS so i hope that doesn't decide to kick in during the meeting.

                  Anyways, goodluck, its sounds to me like you have a laid back trustee....

                      Our 341 is in a few days as well and same thing - we've NEVER been asked for bank statements. I thought it was a little odd and my atty also says they have everything they need. If, at a later date, they ask for them, I'll provide them, but for now, I'm thrilled they don't want them (not hiding anything but don't want them to freak if I have too many restaurants or whatever)...

                          Thanks for all the good wishes and thoughts - prayers too are welcome! I know I am praying through this. We did give 3 months of bank statements to our attorney and I think the copies were sent to the trustee, as well as 2 months of pay stubs.

                          jessegirl, most of my cramps were BEFORE we filed. For some reason, they seemed to pretty much stop after we filed. Hope they stay away!!!!

                            Well, I'm well below median (I'm a teacher--go figure!) and the trustee requested a ton of stuff. I'll produce it without comment or problem; I have nothing to hide, but it's just wild how many variations there are from district to district, trustee to trustee. I copied and printed every single bank statement, check register and am requesting even more pay stubs.

                            I was originally told by the clerk's office (and on their pro se check list) that the trustees request 60 days of pay stubs (which I requested from work), but the letter I got from the trustee asked for 6 months worth. So I'll comply--and hopefully your trustee is just more laid back and assumes what's listed is accurate.

                              I feel a little better knowing that I am not the only one who hasn't been asked for any bank statements. But I have a feeling we will be asked for them at some point...
