I know that the trustee usually asks for bank statements dating back to one year, BUT what is the norm usually? And is it from the date of filing or the date you retained your attorney or the date of the 341 hearing? Thanks

Your attorney will ask for 6 months bank statements(sometimes) just to make sure your deposits are somewhat inline to your Pay stubs and answers on the SOFA, but for filing purposes only the last 90 are required.Disclaimer: I am not an actor on TV, but I play a BK Paralegal in real life. Nothing I say should be construed as legal advice, or really anything but entertainment. Please seek out professional help.

We are above median though, so I am preparing for the UST to possibly request them at some point.Last edited by laurannm; 08-02-2008, 10:50 AM.Filed Ch 7 - 07/10/08

Jessegirl, I received a form letter from the trustee after filing that requested a full year's worth of bank statements as well as the check registers, and he requests this of all his cases. That was only the start; he wanted insurance papers, pictures of vehicles, marriage and divorce papers, a whole stack of stuff. And this was his norm for all of the filers assigned to him.
Keep in mind that trustees vary not only district to district, but trustee to trustee, as to what they request of you. Don't worry about it or read into it, just do your best to get them whatever they ask for and if you can't, tell them why. You'll be fine: if your filing was honest, that will quickly be apparent with a glance at your banking records. Don't think it means you're going to be audited.
Also, unless otherwise stated, everything in a Ch7 is *as of the date of filing*. Only the 60 day limit for creditor objections rides on the date of the (first) 341.
Anyway, I hope this helps. Good luck!!!Nolo Press book on filing Chapter 7, there are others too. (I have no affiliation with Nolo Press; just a happy customer.) Best wishes to you!
