Actually what I think the problem was is that you didn't fax the info to them or bring a copy. It might take another week to straighten out as you wait for the clerk to mail the official letters, but in the end yes they will have to return any monies garnished after filing.
I faxed the attorney and my employer as soon as I got home. I also called them on the telephone.
I believe the $6000 the article refers to is MD's wildcard exemption.
Well, I wonder if this is true in Colorado as well? I need to find out and if so, do what I need to do to get back as much as possible. They got around a thousand dollars out of me before I could get my case filed.
Did you file with an attorney? If so let the attorney handle it. If not, go to nbankruptcy court clerk and explain it and they will help y ou through the process.

A garnishment is not voluntary and as such, not a preferential payment.
But yes, anything after the stay will come back.

I stand corrected
Not only am I not a lawyer, the California BAR association has sent me numerous letters telling me not to even THINK about going to law school. In fact, the lay advice I provide is not even good. In the end remember, you get what you pay for, and here in BK land were not the best at paying.
