    creditor at your 341

    anybody have a creditor show up at your 341? If so what were the circumstances and what happened?

    I wouldn't worry too much about creditors showing up if I were you because I had a business and lots of local creditors and none of them bothered to show up. Not even a peep from the UST.

    A short story from my 341:

    There was only one guy that had 2 creditors that did show up for his case. It's not common for that to happen but that poor guy had a big time business and converted from a chapter 13 to a chapter 7 and the 2 creditors were trying to liquidate some of his business inventory (big dump trucks, front end loaders and stuff) so that they could get paid.

    I repeat, this is not the norm, but I just wanted to show you how that one guy had creditors show up when over 20 of us didn't. Also keep in mind his case was EXTREMELY complicated!!! You'll be fine because at most the 341 takes about 3-5 minutes of yes and no answers and you're done.

      Hi there,
      Creditors usually don't show up, but we had a poster recently that their CU rep showed up to reaffirm their vehcile...nothing big....don't worry.
      May 2008 Hired 1st Attorney/Stopped paying CCs
      May 21, 2009 Retained 2nd Attorney
      May 28th - Filed for Ch 7 (FINALLY!)
      9/11/09 - DISCHARGED!!!!

        my case is pretty simple. Have about 36k on credit cards but I am just worried about one, citibank. I rang up $5k on junk in jan, feb, march. I'm sure they'll have something to say about that! Hopefully, if I do end up paying them back we can work out a reduced deal. Crossing my fingers.

          ALthough we were in a ch 13 341, there was one creditor show up for one case. The creditor seemed to be a small business owner who was mad that he was getting filed on and wanted to tell the trustee that he was going to object to the debtor's confirmation. He had no attorney there and didn't really seem to even know what he was doing but he definetely wanted to be heard.

          Other than that there was a representative from the IRS who was there for a couple of complicated cases. She wasn't there to object to anything, she just wanted to help some debtor's with their isssues on filing their taxes.

            They probably wont show up. How long before you filed did you charge?

              I stopped using it at the beginning of march. I file July 22. Definitely over 90 days

                A creditor loses no rights by not appearing at the 341. They have 60 days from the 341 to file a written objection. Very few do.

                  Ok, here is a 341 story for the record books. I had a client once that had a business where they publish poetry books. The ruse was/is they advertise in magazines for a poetry contest and for people to submit their poems to be judged. Well low and behold everyone won and they are going to be published in a Book of Poems. And by the way Mr. or Mrs. Poetry winnner, don't you want to buy one, two or five of these beautiful leather bound books to give as a gift to your friends and family to show them that despite what they said, you are officially a published author. Well they would keep having "winners" until they sold 4000 or 5000 of these books at $50, $60, $70 a pop. Things were going well for them and they published these "books" a couple of times a year, but something went south and they had to file BK. Well first off, the law firm I was with set a creditor matrix record with over 1800 creditors. The next thing, was sad and funny at the same time, was all of sudden our office got inundated with calls, I mean hundreds of calls, of people angry, crying, screaming and they all wanted their poems back. I asked them if they had kept a copy and some had, but most hadn't ( why I have no idea, the rules were to mail the poem in). So then some of them would say please look for it, the poem starts like this.... and they would recite some of it, but they would usually start crying again. I am not a mean person, but I had to drive a tac into my thigh to not laugh everytime I got these calls. Well a month later, here comes the 341 meeting and I was not going to miss this. Sure enough any and every winning "poet" within about 150 mile radius showed up at the 341 to object to the BK, and they wanted their money and their poem back....NOW!!!! I never knew poets could get so vicious and violent when you don't give back their poem.

                      Like everyone has mentioned it is not common to have a creditor show up. I did however. Usually the only time a creditor will show up is if it is personnal or they know you. The creditor that came to mine was my business partner, I was in his wedding, and I listed him as one of my creditors when our busness failed. The meeting like all people have mentioned lasts about 5 minutes. Since my creditor was there my trustee asked a few more questions based on some of the objections that the creditor had. After the trustee was complete the creditor my friend, and co-owner of our failed business was given time to answer questions. It lasted about 15-20 minutes total. Your lawyer will or should prepare you for what you can expect. Good Luck!

                        I was the only one who had somebody show up on the day of our 341.

                        Actually I was probably a little misleading in my previous posts, Our representative from the CU actually talked with us out in the hall and never actually went into the room where we had our 341.

                        The way our lawyer put it is, every place is different when it comes to filing bk. We leave in the middle of our state, he said we live in a bk friendly area, he said we have a great trustee and judge. He said that they know that every case that they file north of our area that they are gonna have a fight on their hands. He said whether its a 7 or 13 they know there is going to be a long drawn out case.

                            We owed BOA over $30,000 and they didn't show up. We only had our 341 one week ago and are crossing our fingers that the don't dispute our bk.
