Pacer Question?

I think we are due to be discharged from our Ch 7 filing today 7-25. I'm on pacer. com and on the home page it says that our date of last filing is 6-30. What does that mean? How can I find out if the case has been discharged?

Blue, if July 25 is 60 calendar days from your first (or only) 341 meeting, and in that time no creditor objections have been filed and there are no other unusual problems with your bk (a filing of presumed abuse by a trustee, for example) then you should receive your discharge shortly. Exactly how long depends on how busy your district is; it could be days or it could be months, but it usually happens within 3 weeks.

The important thing is that, even though you don't have the paper in hand, you're safe: if no one, including the trustee, has filed any objection within those 60 days post-341, it's a done deal.

"Date of last filing" in PACER refers to the last time something -- anything -- was filed in your case. If you know what was filed on June 30, great. But if you haven't looked at the various docs actually filed, you *really* need to go ahead and access your case and pull up that last filing, 8 cents be damned. You'll know when you're discharged because it will be a separate filing, not just a PACER flag; same for the order of closure that officially closes your bk case. Plus, you'll receive notice by mail when you're discharged.

Thank you. I was reading some paperwork last night and I think maybe it's August 1st for our discharge date if all goes well. We had our first and hopefully only 341 meeting on June 2nd, so it seems like 60 days from then would be Aug. 1st. We will be watching for any paperwork regarding this to come in the mail.
