We finally had our 341 yesterday, and I'm glad its over. I think everything went OK, the trustee said we should be getting our discharge in the mail if there are no problems in 60-70 days. We were the only ones who had a creditor show up. Luckily it was a lady from my credit union who was trying to get me to re-affirm a motorcycle loan. She was very nice, and offered to re-write the loan at 0% interest. Then she very politely pointed out that if we re-affirm the loan, then we can continue to do business with them. If we don't reaffirm the loan and the CU takes a loss on it then we will not be allowed to do business with them. She said it might be difficult to find someone to bank with after the bk. So I'm not sure yet if I am going to re-affirm the loan or not, I will owe them around $4700 and the bike should sell for around $5000. I am considering re-affirming the loan, they have been good to do business with. Then if I can't afford it later on, I could always sell it.
Our 341 lasted about 10 minutes. We set and watched a guy before us, they only asked him a couple of questions and then he was off. We were asked several questions like, our names, address, employers, medical bills, 401k, reasons why we were filing bk, and he asked us about our house and cars. Our trustee was very dry, wasn't friendly at all, never smiled or joked around like other story's from here.
We talked with our attorney for a couple minutes before our 341, he said as long as the 341 went OK, then there was nothing else anyone could do. Has anyone had any problems with a chapter 7 after the 341? What else could the creditors do?
I am re-affirming my house and a heloc loan of $15,000, and a 401k loan of $15,000 (which was used to pay off cc's). Boy it sure was stupid to take out a 401k loan for $22,500 to pay cc's, but at that time we had no intentions whatsoever of filing bk.
Hopefully this will all go through, if so, I never dreamed it would be that easy to walk away from $65,000 in cc debt. Not that this was a good thing to do, we have had many sleepless nights. For me it was one of the most humiliating and humbling things I have ever been though. We WILL NEVER allow ourselves to get in financial trouble again. Most of our debt was from medical expenses and cc's used for basic living expenses. Unfortunately my employer restructured and I lost $10,000 -$15,000 a year. We have had to make a lot of changes to live within our income.
