    341 Finished - I'm in the 60 day club now!

    We finally had our 341 yesterday, and I'm glad its over. I think everything went OK, the trustee said we should be getting our discharge in the mail if there are no problems in 60-70 days. We were the only ones who had a creditor show up. Luckily it was a lady from my credit union who was trying to get me to re-affirm a motorcycle loan. She was very nice, and offered to re-write the loan at 0% interest. Then she very politely pointed out that if we re-affirm the loan, then we can continue to do business with them. If we don't reaffirm the loan and the CU takes a loss on it then we will not be allowed to do business with them. She said it might be difficult to find someone to bank with after the bk. So I'm not sure yet if I am going to re-affirm the loan or not, I will owe them around $4700 and the bike should sell for around $5000. I am considering re-affirming the loan, they have been good to do business with. Then if I can't afford it later on, I could always sell it.
    Our 341 lasted about 10 minutes. We set and watched a guy before us, they only asked him a couple of questions and then he was off. We were asked several questions like, our names, address, employers, medical bills, 401k, reasons why we were filing bk, and he asked us about our house and cars. Our trustee was very dry, wasn't friendly at all, never smiled or joked around like other story's from here.
    We talked with our attorney for a couple minutes before our 341, he said as long as the 341 went OK, then there was nothing else anyone could do. Has anyone had any problems with a chapter 7 after the 341? What else could the creditors do?
    I am re-affirming my house and a heloc loan of $15,000, and a 401k loan of $15,000 (which was used to pay off cc's). Boy it sure was stupid to take out a 401k loan for $22,500 to pay cc's, but at that time we had no intentions whatsoever of filing bk.
    Hopefully this will all go through, if so, I never dreamed it would be that easy to walk away from $65,000 in cc debt. Not that this was a good thing to do, we have had many sleepless nights. For me it was one of the most humiliating and humbling things I have ever been though. We WILL NEVER allow ourselves to get in financial trouble again. Most of our debt was from medical expenses and cc's used for basic living expenses. Unfortunately my employer restructured and I lost $10,000 -$15,000 a year. We have had to make a lot of changes to live within our income.

    Congrats, you are officially in the 60 days club!
    Thanks for sharing your 341 experience with us, as I'm sure many of us who haven't filed yet are on edge about our own 341 meeting. There are so many threads that talk about NOT reaffirming, but I think you'll benefit from doing it, since the motorcycle is worth more than you owe (are you sure about that?). I wonder *why* the credit union sent a rep to the meeting? I guess I'm just paranoid...

        Congrats! Mine is scheduled for 8/25 and I'm worried. I would also be curious to know if anyone ever had any problems after the 341 meeting.

          Congrats and welcome to the 60-Day Club!!

          My 341 was 16 days ago, and it wasn't bad at all. It lasted maybe 5 minutes. I thought it might be longer and more detailed because we were over median by a lot and our debt was 162k. But the trustee was cool and made jokes. Now I am sitting around waiting.

          We have 2 vehicles, one we are returning and one we are keeping. Both are financed from the same company. So far, no one has contacted us about picking up the return one or even signing anything for the one we are keeping.

            They sent a rep. just to see if I was interested in reafirming the motorcycle or returning it. She was very nice about it! I still haven't decided what I'm going to do.

              Congratulations and Welcome to the 60 day club. I am already down to 30 days left so trust me when I say... it will go by fast!

              If the credit union has offered to lower their interest to 0% and not add in additional fees it sounds like they really want to work with you! Our credit union did not show up at the 341 but I just received the reaffirmation papers. Almost $900 I believe in fees! no reduction in interest(not that it matters much as we are only paying about $30 a month towards interest at this point). They actually changed our minds for us. We have decided that their reaffirmation agreement is definately worded to benefit them. What are they going to do with our vehicle if we surrender it? Maybe get a couple thousand... which is far less then we would have paid.

                    Just out of curiosity, had you spoken with the CU about the loan before the meeting or did they just get the 341 notice like every other creditor? I am also guessing you had kept making payments on time?

                    I'm curious as we have an auto loan through our CU and while they are decent to work with, I have a sneaking suspicion they will play hardball. I need to get the payments completely caught up so I have more leverage. I would like to talk with them once I file, so I can know what to expect, but I am also very cautious with regard to that as well.
