      Does this happen in both 7 and 13?

      Is it less likely in a 13?

          The whole process is a joke.

          The states with the highest homesteads are Texas and Florida, Bush country, both. The laws were written to protect their wealthy friends, yet that trustee acts as though you, a normal person, is somehow in the wrong for filing? Hiding a washing machine, perhaps, while the likes of Simpson live in a million dollar place? Sad state of the union.

            Karma, I am in Ft. lauderdale. My Trustee through his lawyer made the same threat. She has to pay several hundred dollars for a company to remove your items and if they feel it is garage sale stuff they can refuse and she has to pay them My Attorney explained to me how the system works. She stands to lose if your items are just normal stuff. Given that, I would call her bluff. I know it makes you nervous and I know the feeling well, hang in there. I really would try to avoid giving up cash.

              That trustee is a hippocrate.

              She has a past, probably of unethical charges somewhere along her path. It's like the chief of Freedie Mac being paid ten million, while the place flounders. They are all the same, all of those lots.

                  I am in the tampa district also. we hired an appraiser thru our attorney, it was one the trustees use also, do you know who it is?

                    It's not politics, it's facts.

                    BK laws were written to protect the rich, not for us. Don't fool yourself to the contrary. That's just why those two states have such amazing homestead exemptions. In Ohio it's FIVE thousand dollars!! A joke.

                      AMEN!!!! Why do you think the new law has a convenient Chapter 7 loophole in it for non-consumer debtors? Thank God I was able to take advantage of that loophole, because I'm sure the new law wasn't designed for broke people like me because I make more the Median Income for my state and I'm sure if it wasn't for my failed business the trustee would have fought for a Chapter 13 for sure, even though I'm broke after every paycheck. Why is it we don't see more rich people being forced into Chapter 13's? I'm sure they have plenty of disposable income and assets worthy of hiring an appraiser to value. Food for thought isn't it?

                      In my opinion, it will cost the Trustee more to hire someone to move that stuff than your stuff is really worth. I believe in fighting fire with fire. Gather all of your information ahead of time and be ready. Hopefully you will get a nice appraiser like I did for my home and he/she will be understanding and won't bother with your stuff.
